5 siblings 1has mental health issues

Hi me and my sister are 2 of 5 siblings who are executioners of my mothers estate husband died 10 years ago any advice would be great as thinking myself to get a laywer .i have probate granted now dividing the estate.. heres my problem 1 of my brothers has mental issues and i want to do whats right for everyone .

    I forgot to say theres no will thanks . my brothers suffers from Paranoid Schizophenia .also lost the use of his leggs as not going out so becoming incapable of looking after himself also hes liabel to spend it on stupid stuff was buying drugs online hence my worries and with his medication really sent him to a dark place. as im thinking putting into an account to pay for the help he requires my sisters his carer but its really hard to keep him on the straight and narrowthank you so much for replying
  • Unless someone holds power of attorney for him and he has lost the metal capacity to make decisions, even silly ones, then there is little you can do.

    You must distribute the will as directed and not make your own judgements on what you think others should be doing with their inheritance.

    As an executor you need to do what the will says, or follow the rules of intestacy. You do not have flexibility or discretion.

    As a concerned sibling you can suggest to your brother, but not control him. If he has a social worker you can also inform them of the situation.
