Claiming on new build warranty question...

Hello

So my house is a new build which I've been living in for 7 months and i am having some issues with creaky floors.

I've decided after the builders trying to fix this and using delay tactics I am going to write to the Insurance which is "premier Guarantee"

My question is that I read somewhere that written evidence of the problem is required yet my property is a shared ownership through a housing association.

I have emails of me complaining and updating the housing association but none that are directly to the developer.

I was told defect complaints have to go through my housing association. Where would premier gurantee stand on this?

    Best of luck with this. I have heard many stories of people trying and failing to get repairs paid for by a warranty, they seem in many cases not worth the paper they are written on. So it will be interesting to see how you get on.

    But read the small print, you might find in the first year it is all the builders responsibility, so you may need to pursue that further.

    Perhaps you should try direct to the developer as your next step. Get their surveyor or representative around when you are there and meet them face to face and show them the problem. It may well be the HA that is the sticking point and the developer may well be happy to fix the issue.

    basically the situation so far is the builders have tried to fix the creaky floors yet all attempts have either failed or only worked for a short period of time.

    I have about 4 months left of the defect period and the builders mentioned taking it to the insurance. I dont understand why they would want to do this now as they have to fix any defect in the first 12 months (in my case)

    Surely i would imagine any issues raised during the defect period would be covered even after the period ends.

    its like a never ending cycle of

    1 reporting a issue to the housing association,
    2 A phone call from the builder organising a repair
    3 they either do a poor job or need to come back

    This continues and i am starting to feel that they are trying to run down the defect period.
