stamp duty

My partner and I own separate homes in the UK. This year we intend to purchase jointly a property in Spain and later sell both our UK properties to buy a joint one in the UK. This will remain our main home - will we be liable for the extra 3% second home stamp duty?

    The SDLT position will depend on the details!
    Are you married / in a civil partnership, or "just" a couple?
    Have you each lived up to now in your own property? Or are you both living in one? Is either rented out, or has it been? If you do not each live in your own property then how long ago was it that you last lived in it?
    What is the plan for the Spanish property? Do you both intend to live in it for quite a while? Or is it a temporary arrangement / holiday home? What will it be worth roughly? Less than £40k? Less than £80k? More?
    Where will you buy the new home? England? Scotland? Wales?
    Will you both live there long term as your main or only residence?
  • SDLT is uk only, not sure what system Spain has, but as long as your not buying a property in the UK then no...

    If you sell your properties in UK and move to Spain but later wanted to buy again in UK then the Spanish property would count as an owned house so unless it was sold you would have to pay the 3% SDLT...
