Got hit from behind by a non insured driver.

Need advice... first accident yesterday.

I was in stationary traffic and got hit behind by another driver doing national speed limit.

Pulled over and exchanged details. She said she had insurance and would sort it when she got home. I took pictures, witness saw it happen and willing to give statement if necessary.

She didn’t want to go through insurance and asked for a quote. I still rang mine when I got home
To inform me she doesn’t have insurance.

So now what.... I know I have to pay my excess which is eye wateringly high - £700.

Got a quote for damage looking at £3-4K. Which she can’t pay and has told me to go through my insurance.

So.. what will happen now.

- will I get my excess back?
- how long does it take?

I haven’t got legal cover on my insurance but want to claim as I’ve got the week off work and is a loss of earnings.

  • You will only get your excess back if she has the means to pay.

    There may however be a chance the MIB will cover the uninsured loss.

  • Unfortunately it sounds like an at fault claim for you then.

    The MIB May cover the uninsured loss if you claim through them.

    Have you reported the matter to the police?
  • Yes. Going in today to complete the form, provide picture proof and text messages from the uninsured driver.

    I hope they get some come back from this all.

    Getting hit by someone at 60mph?! I'm surprised the damage is only £3-4,000. Lucky you're ok, but a pain that they weren't insured - another driver deciding the rules don't apply to them.

    I'm surprised this isn't a police matter. (edit: I see that it is)

    I updated my insurer with the details of my personal plate, but they never updated their systems. I essentially drove around for almost a year with no insurance. I only knew when I got a letter from some official department (Motor Insurance Database?) saying my number plate wasn't on their database as insured.

    So much for all the ANPR everywhere apparently keeping an eye on this sort of stuff. I drive into London a couple of times a week and often drive around Birmingham, up and down the M1, M6, M25 etc. But never got pulled.

    You can always send an invoice to the woman for the amount you've lost and when she doesn't pay it file a claim in county court. There is absolutely nothing at all to stop someone claiming directly off a third party for damages in an accident. Technically that is actually what happens when you make a claim. If your insurance is handling it they make a claim against the other individual and that individual passes that on to their insurer to pay out however in most cases if your insurance company knows the name of theirs they'll just deal direct to save on delays. Car insurance is actually insurance to cover the cost of those claims.

    At least for £35 if she doesn't pay you have the satisfaction of knowing she's got a CCJ which will cause her a bit of grief for the next half decade.

    Go to a lawyer who will run a non-fault claim for vehicle damage and any personal injury you may have suffered.

    They will treat this as an MIB claim - it will cost you nothing

    And if the OP has comprehensive insurance they’ll tell them to claim on that policy.
