Having an underwritten product in place is no guarantee the case will get taken on.
but it is a guarantee that you get what you paid for in the contract or have rights of redress.
With a no-win no-fee company they we you nothing and can pick and choose.This is the same criteria operated by no win no fee solicitors.
For example if I had a case that had a high likelihood of success but little profit then why would a no-win no-fee company take it on?The reason they cost naff all is that the underwriters behind the policies never pay out any legal fees due to the "reasonable prospects" clause.
Some uninsured losses do not get paid legal fees.
No-win no-fee companies (in general) cherry pick the cases with high profits.
As with all groups in life there are good and bad companies, but they have NO obligation whatsoever to the applicant.the bottom line is that the lawyers who act under these policies never get paid by the legal expenses insurers, they only get paid fees on the cases they win, by the insurers of the other party.
Where an insured party is entitled to contracted service.
No win, no fee companies often co-erce of force people into expensive hire car and on occassions the driver has to attend court as court proceedings are in their name !!!!Motor legal protection is just a pure money spinner for insurers as they make up to a 6000% mark up on the policy when they sell it to you and then they make £££ from the lawyers who buy injury claims from them and credit hire companies who provide you with hire after a non-fault accident.
I believe there are cases such as these where there is no entitlement to awads for costs and that as a consumer I have entittlments under insurance to legal services. Please correct my knowlegde as SOMEONE has to fund the legal services in claims where there are no awards made by the courts for costs.
BTW - My FIL had an accident where his insurer refunded his uninsured losses directly BECAUSE he was entitled to pursue them under his legal insurance (it was the insurance cos decision to pay direct rather than pursue).
He would NOT have got this if he didn't have insurance and no-win no-fee would not have pursued a small excess against a pedestrian.
So there you are - 1 anecdote where legal insurance was a benefit.0 -
Onan - even if you think this is of little/no value, do you not agree that those of us who do want a contracted policy with FCA regulation/authority, should be able to have the choice to buy it and choose to discuss and buy the best value policy?
Surely we are entitled even though you see little value (I don't agree there is none because as I said my FIL benefitted).0 -
