New Generation Parking

I was wondering if anyone would be able to help me or may have experienced the following?

I received a Parking Charge Notice from New Generation Parking for parking on double yellow lines which I don't dispute. The PCN stated that a payment of £100 needed to be made and this would be reduced to £35 if paid within 14 days. I made the payment straight away but the only option was to pay the £100 and I assumed that if their records showed payment was received within 14 days i would be refunded the £65 but this has not been the case.

This payment was made over 2 months ago and i have been trying ever since to get my refund but have had no luck. Ive emailed them, put in an appeal and also spoke with them on the phone. During these phone conversations i have been told the following -
Someone has been trying to get hold of me
I would get a response within 48 hours
Been put on hold whilst they send me an email as my email address was incorrect apparently (I never received an email and remained on hold until the phone went dead)

Everytime I have rung they have an excuse as to why i have not been contacted.

Has anyone had a similar experience or can anyone offer some advice?

The advice here is not to pay but to appeal. We have a very high success rate with helping people do this.
Yellow lines on private land are just graffiti.

Unfortunately I don't think you have a chance of getting you money back.

Next time come here first and read the NEWBIES thread that tells you how to beat these scams.

All you can do now is to complain to the landowner and your MP about this unregulated parking scam.

These are some of the comments made by the MPs in Parliament concerning the unregulated parking industry (Feb 2018):

    https://hansard.parliament.uk/commons/2018-02-02/debates/CC84AF5E-AC6E-4E14-81B1-066E6A892807/Parking(CodeOfPractice)Bill

''Rip-offs from car park Cowboys must stop''; unfair treatment; signage deliberately confusing to ensure a PCN is issued; ''years of abuse by rogue parking companies''; bloodsuckers; ''the current system of regulation is hopeless, like putting Dracula in charge of the blood-bank''; extortionate fines; rogue operators; ''sense of injustice''; unfair charges and notices; wilfully misleading; signage is a deliberate act to deceive or mislead; ''confusing signs are often deliberate, to trap innocent drivers''; unreasonable; a curse; harassing; operating in a disgusting way; appeals service is no guarantee of a fair hearing; loathed; outrageous scam; dodgy practice; outrageous abuse; unscrupulous practices; ''the British Parking Association is as much use as a multi-storey car park in the Gobi desert''; and finally, by way of unanimous conclusion: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists and ordinary residents should not have to put up with this''.

These are the exact words used, so you should quote them to your MP in a complaint and ask him/her to contact Sir Greg Knight MP if he wants further information about this scam.

    You paid them...!

The chances of getting your money back are slim to nonexistent I'm afraid. Unless you paid by credit card, where it might just be possible to have them do a chargeback.

Read-up on the Newbies Sticky so you are prepared for the future and cost them more money by helping others escape their preposterous charges.

You could issue a Letter Before Claim, followed by a MCOL (Google both) for the balance, which would cost you £25, but which you would recover from them if you won your case.

A pretty simple procedure which might be enough to get them to cough up rather than have to defend themselves in the small claims court. It's a much easier process to issue a claim than to defend one, a situation readily exploited by PPCs (including NGPML) to intimidate motorists.

    Turn the tables! Karma.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

OMG you paid a HUNDRED POUNDS to this lot, and didn't research first?

You didn't even need to pay them 35p, let alone £35 or £100.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
