Help Re old landlord

Hi All.
Sorry if this is in the wrong place but wasn't too sure where to put it.

Basically..We rented a place for over a year and when we moved in the flat was in a really bad way so we bought new curtains, light fittings and net curtains as well as painting the place.
When we were due to move out the landlord decided he wanted to buy all the curtains etc we put in ( we did intend taking them with us because he wasn't the best landlord in the world).
The estate agents asked how much and we said £200 for the lot. They said they needed to provide the landlord with the receipts and when I said we have a couple but not all as we didn't intend leaving them we heard no more.
On the day of moving out we took down all the curtains etc as we hadn;t received anything from the landlord or estate agents. When the ES saw we had they said he still wanted them and we'd get our money within 2 weeks. ( you can guess what happened now???)
We are taking landlord to small claims court for this £200 but he is denying that he owes us the £200 and only admits part.
Now we have to go to court and I can't cope!!
The estate agents sent us a letter saying he only agreed to pay £200 on receipt of the receipts but I told them we didn't have them. So basically where do we stand???

I'd rather just have everything back from the flat than go to court as I'm 8 months pregnant and can't do with the stress.

I'm sorry it's so long.
Any advice I would be grateful.

  • How much is he saying he will pay you? perhaps it would be better just to take it to avoid the stress of going to court.

    If you do want to go to court and you don't have the receipts I really don;'t know what else you can do. It's your word about the costs really. Also, the curtains would now be described as second hand I imagine so it's not like you could just go and say 'look what the shop is selling them for' as proof.

    If you still have the receipts, ask them for that amount and request that anything that is not on the receipts is returned to you. If LL is not willing to pay for something he doesn't know the cost of then he cannot expect to keep those items.

    seems fair.end of the day until he has paid it is your property. if he's not happy with the cost he can return them given he is not disputing you bought them
  • Thanks for your replies. I'd be happy to do that but now he's put in a defence for the full amount so ?? I asked for our property back initially and he basically said if we went anywhere near his flat he would sue me until I was blue in the face! ( nice guy).
    Will put the above suggestions to the court thou...

    I hope he gave you that in writing! It's the sort of thing you could show the judge, and then the judge will immediately find in your favour without even asking any more questions.
    Bankruptcy isn't the worst that can happen to you. The worst that can happen is your forced to live the rest of your life in abject poverty trying to repay the debts.
  • I wish he had...it was over the phone unfortunately... but my partner was there and he heard it. But that's probably not much use! When it goes to court I probably wont be able to go. It's too far from where we live now and I'm expecting a baby soon and don't want to go into early labour!!
