Hi
i am trying to help friends with a benefit claim and i need some advice.
situation is
claimant is over 65 and receives nothing , partner is under 65 and receives ESA at 460 per 28 days.
claimant cannot claim state pension due to only working about 4 years. we have tried to claim pension credit and was told that the partner would have to close down their ESA claim.
so my question is would they be better off claiming PC.

Surely they get HB or help with the interest on a mortage or don't they have a mortgage? What about help with council tax?
Could the partner claim PIP?0 -
Sorry yes they do get HB & CT, but claimant receives no income. PIP only just started claim0

They must have contribution based ESA otherwise it would be a lot higher?
There is no need to shut this down to allow a pension credit claim it would only be income based ESA that would need shut down.
PC would be about £243 weekly less there ESA at £109.
It would be pretty disgusting (But not surprising) if HB & CTB have allowed you to claim with such a low income and not told you to claim the extra from PC.0 -

Thanks for that link. I have never heard of that benefit. I was on ESA which was shut down when I got my state pension. I didn't know that you can claim a top up.
