PPI - Plevin Ruling

Hello,
Trying to get some general advice on this one, first time I am posting on here so hopefully it goes ok
I put a claim in against the Nationwide (they purchased the Derbyshire Building Society where I had my mortgage from 1996 to 2003) for a PPI claim. The reason for the claim was I was heavily commissioned in the role I had, 25% basic wage and 75% commission and any PPI policy wouldn’t cover non-guaranteed money, hence the policy not being the paper it was written on and not covering my mortgage payments
The claim was rejected, and after trusting a PPI claim company who royally messed it up, the 6 month time frame elapsed to take it the Ombudsman
After watching Martin Lewis Money on TV, I learnt about the Plevin ruling and wrote to the Nationwide again. This has just been rejected again but the rejection letter states I can complain to the FOS within six months for Non-Disclosure of the Commission
My policy ended in 2003 and I believe the rules are for policies after 2008, can anyone help with what I can or cannot do at this stage ?

To be honest, your complaint reason is not strong as your method of remuneration wouldnt prevent you making a claim.My policy ended in 2003 and I believe the rules are for policies after 2008, can anyone help with what I can or cannot do at this stage ?
Mortgages have different dates regarding plevin compared to loans and credit cards as Mortgages were not always subject to consumer credit act but came under MCOB (FSA). So, the "in scope" dates are different.
However, in this case, as the policy was not in force at the qualifying date in 2008 then you fail on the qualification criteria.
