UKPC Parking Ticket

JR836311DJR8JRHi I want a bit of advise. At the beginning of December last year my daughter parked in a disabled parking bay as she was taking her grandma( my mum) to a few shops. She has had a hip replacement, is waiting for the other hip operation and walks with a stick. She doesnt hold a blue badge and my daughter received a parking notice. She didnt know it displays ' only for blue badge holders) but everyone said dont do anything so she left it and received a letter and since then another one gone up to £100 threatening court/baliffs etc - please advise. So many people say just ignore it but i dont want the situation to get worse83JR836311D6311D36311D

    Perhaps the "so many people" will help you in court with this should it get that far, no you should not have ignored it.

    Please read the newbies thread then come back if you need more help, don't bother about the threats from Debt Recovery Plus or Zenith they cannot take you to court, but UKPC might.

    Why haven't you complained to the land owner?

    Whether a disabled person has a BB or not is immaterial in a private car park. PPCs are required by law to make "reasonable adjustments" to allow for the "protected characteristics" of disabled people under the Equality Act 2010.

    As the PPC have failed to do this they may well have flouted the Law. Steps are afoot in Parliament to stop these companies scamming the public and they may well be put out of business by Christmas, watch this video

    The keeper should respond to tell them (without saying who was driving) that Blue Badges are not the only indicator of disability need, and no doubt the ticketer watched the elderly passenger walk away with difficulty, using a stick. Therefore, it is fair to say that UKPC knew that a passenger in the car has mobility problems, and certainly qualifies under the definition of disability in the Equality Act 2010. Such people have 'protected characteristics' and are legally entitled to use any disabled provisions supplied by the retailers, including a disabled bay.

    It's important that UKPC are informed NOW about this issue. Not because they'll just cancel (they won't, but they might offer to cancel for £15 which is something the keeper might think about).

    UKPC are nasty ex-clampers so don't write too politely, not a nice company, and CERTAINLY never ring them! And do this too, and DO NOT PAY:

    Finally, send a copy of your letter to your MP and to the shopping retailer or managing agent/owner of the retail park* at the same time, complaining that the ticketer appears to have watched the disabled lady hobble away, which means UKPC have broken the law by discriminating when they 'knew or should have known' about the service-user having protected characteristics requiring a reasonable adjustment.

    Remind the MP and retailer that this is unlawful discrimination and that Blue Badges are only a Council scheme (on street), have no lawful application on private land and the scheme is routinely abused by private parking rogue ticketers, who use it as an excuse to pretend that no other people can be protected by the Equality Act 2010. That's untrue, and disingenuous of the parking industry to run the lie again and again, so that even landowners and some MPs have fallen for it and believed a Blue Badge is the be-all and end-all. It can't be in law, and the EA is silent about permits, badges, or people having to 'prove' disability need.
