PCN / Scotland / Lease Car

Hello,

First thread. I`ve read the newbies thread and done a search so I "think" I have an answer but wanted confirmation.

I have a personal lease car. I have received a PCN from Euro Car Park addressed to me as the registered keeper as the car I lease was parked for over 2 hours in a car park in SCOTLAND. I cannot confirm nor deny who was driving at that time.

As the car is a lease car, I do not wish to have the lease company involved.

As ECP can only pursue the driver and not the registered keeper (I believe) is my best course of action to write to the company confirming that:

I wish to confirm to you I was NOT the driver of the vehicle.
- I am not obliged to disclose the identity of the driver and this does not affect my liability in this matter .
- You will need to pursue this claim with the driver once you identify them.

Do I need to do anything further or should I just ignore the letters?

    I would also complain to the retailer/landowner to get it quashed, if the driver was a shopper.

    I assume you have a NTH addressed to you because they firstly wrote to the Lease firm, who gave your name as hirer.

    If so, then also write or email the lease firm and point out that if any other letters arrive they must pass them to you, as you have replied to the parking firm but in Scotland, the POFA does not apply to parking on private land and so the Lease company have no liability and no further interest in the matter.

  • Apologies, I`m not sure what a NTH is?

    I will certainly write to the landowner (it`s a retail park) but wouldn`t I then have to name the driver?

    I haven`t had confirmation from the lease company if they received a letter as I couldn`t get hold of the department as yet.

    How did the PPC get your address?
    Could've only come from the leasing company, couldn't it?

    You should be able to tell from the letter. Notice to Hirer (follows a NTK sent to the registered keeper).

  • Thanks. I just checked the abbreviations on the newbie thread. Useful info!

    There`s nothing on the letter stating NTH. It states:

    "Why have I received a parking charge notice?
    You were the registered keeper of the vehicle when the parking charge notice was issued"

    There`s information stating they obtained my details from the DVLA so I assume this is basically a NTH/NTK? I had understood as a lease car I was not the registered keeper.

  • The lease company has the V5. I`d always assumed for personal leases that the lease company was the registered keeper. I`ll need to check with them.

    I`ll write to the retail park as well though as per your advice. Appreciated.
