Tenant gives notice then new rental falls through

Hi

I was given a months notice by a tenant which I accepted.
My property is now on right-move and I think we have an interested person.
I am concerned that my current tenant has not been given a definite yes from his new landlord.

If they decided to stay put and I have an agreement in place with a new tenant, what's the procedure and consequences?

    Well, you shouldn't have an agreement in place with a new tenant until you have procured vacant possession, otherwise it gets messy. Have you? If not so far, than avoid doing so!

    No I do not have an agreement in place and will not until they leave.
    But I would still want them to leave ASAP and if they refuse wondered if anyone had any advice on the matter.

    If the current tenant remains in the property after the notice period ends then you will have to go to court to get a possession order. You can also charge the tenant double rent under the Distress for Rent Act 1737.
