  • So basically to make sure I dont get a CCJ on my file its best to pay them.

    Being as I have received letters for the other fine, I dont want this taken into consideration when asking for a set-aside due to not receiving court papers.

    Its best to get it set aside!


    You misunderstand - this ccj won't get mentioned at all in any other court hearings you are involved in whether it is set aside or not

    I will have a think, I would love to risk getting it set-aside but if it doesn't then having a CCJ will effect work-wise as well as having to find £500.

    Majority of the cases I have read of a set-aside being granted have been where papers have been sent to wrong / old addresses, which is not the case for us.

    If your employment is in jeopardy by having a ccj against you, then bear in mind that yours will already be on the register (and your own credit files)
  • Oh poo, But I though If it was paid within a month then it would be wiped? (Judgement for claimant dated 06th Feb). Or is that 1 month from the county court letter?

  • Ok Thanks everyone. (I am all for applying for the set-aside, Hubby however wants to play it safe and pay it and get the CCJ removed).
  • Also I forgot to ask, what happens when the CCJ is sent against the registered keeper but was not the driver?

    Yes pay it within a month and you can get it wiped.


    But as posted it will be on the register now (immediately after it was issued!)


    To be sure it gets removed then don't rely on the claimant to inform the court


    You can do so yourself (with proof of payment - send a SAE along with the payment and a receipt for them to sign and return to you)
