You will win, either on the POFA issue or the fact you say they've not shown a witness statement or contract from the landowner. No idea why they have bothered to contest your winning appeal!
I would just change this sentence to avoid the phrase 'I was the driver' even when denying!ParkingEye have the responsibility to prove I was the driver. They have failed to do so.
Maybe:ParkingEye have failed to evidence that the appellant is the individual liable, which in this case is only (potentially) the driver.
You may have to remove waffle, as you only have 2000 characters on the Portal for comments.
So you might need to remove this sort of full sentence to make it fit:
'Dear POPLA' and
'as per my original appeal' and
'As POPLA is aware, this is not the case, and ParkingEye are making false claims that do not hold up to the standards set' (could just put 'This is not the case').PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I've double-triple checked, and there definitely isn't anything regarding the landowner contract. They have a signage plan, and just a couple of statements saying "ParkingEye can confirm this is private land", but nothing to show it.
Is there anything I may have missed? I'm just a little nervous they'll reject the claim.0 -
