I am looking at using a small claims court to get the money I lent someone. I live in England and he lives in Scotland.
How do I go about this with him living in Scotland?

For Simple Procedure you complete a Claim Form (Form 3A). Once you have filled in your form, you should print it and either post or take it to the sheriff court that should deal with your claim.

If the quantum is over £5000 or Simple Procedure does not apply for another reason, you will need to use Ordinary Cause and for that you will almost certainly need a Scottish solicitor to advise you and serve the writ on the defender.A kind word lasts a minute, a skelped erse is sair for a day.0 -
