Want to move out of Student House - Help!!

Hello..

I have been living in student accommodation for 1 Year and about 7 months. A few months a go i enquired about moving out as I was thinking of leaving university, this was around September. The letting Agency told me that i would have to sublet to another student. I changed my mind however now I seriously want to move out as I am leaving Uni, due to my own personal circumstances. I want to get my own rented house with my partner but I feel that this student house will hold me back. What are my rights? Is there another option they might not tell me about? Surely if I leave Uni, I can leave my student house?

    Q) What has you leaving university got to do with the contract between you and your landlord?

    A) Not a sausage.

    You can physically leave the property but legally you are liable to pay rent until the end of your fixed term contract. You wouldn’t be happy if the landlord expected you to move out part way through the contract due to a change in his circumstances would you?

    What kind of tenancy do you have? Is it just in your name or is it a joint tenancy with others? Do you have a guarantor?
  • I will be physically leaving either way, but I would rather end my contract as I would then be paying rent in a place i wont be living in. I have personal circumstances as to why i am leaving, not just simply leaving for the sake of it.

    None of which is legally relevant to your contract with your landlord. You need to find someone else acceptable to your landlord to take over your tenancy or pay the rent (and possibly the associated bills) until the end. What does your tenancy agreement state about termination ?

    so you have a contract to pay rent until the date of the end of the contract

    whether you occupy the premises you rent is irrelevant
    what your personal circumstances are is also irrelevant

    the agency has, quite reasonably, told you that your Landlord (for whom the agent works) will allow you to stop paying rent if you provide a replacement person who will take over paying rent. No new person = no release for you from paying rent

    I seen online about a break clause in tenancy contracts, they can be ended etc. Just thought id ask, thanks though!

    From my personal experience its not so often you will find a break clause in a tenancy agreement for student accommodation. Have you checked your tenancy agreement to see if one is there?

    Well, we can't see your contract, but you can, so tell us, is there a break clause in it? It's fairly unlikely in student accommodation, but if there is and you are at a point in your tenancy agreement when you can exercise it then you can do so.

    If you want legal advice on your rights and options, you need to clarify your legal situation.

    That will be partly basad on the law (we can advise) and partly based on your contract (which we can't see).

    Please quote the terms of your contract - not vague statements but precise quotes please.

    In particular:
    * start and end dates
    * rent and rent payment dates
    * any break clause
    * any other clause relating to notice
    * and importnatly, whether yours is the only tenant name on the contract, or whether you are a'joint and several' tenant along with others in the property on the same contract.

    As others have said,your idea of 'fairness', and your reasons for wanting this, may be enough to pursuade your landlord to be lenient, but have no impact on your legal obligations should the LL choose to enforce them.
  • Your university will have something like a Wellbeing Officer and there is the student union. Ask for their advice. And I am afraid you really do need to check your tenancy agreement very carefully to see if there is in actual fact a break clause. It has to be there on your contract for you to be able to use it.

    Does your contract state that you are all liable for the total rent? If you leave without getting someone to rent in your place, it might be that the other students have to pay the rent for your room for the rest of the year. If you had to supply a guarantor, the guarantor will have to pay if you don't get someone to rent in your stead.

    It's frustrating the amount of young people who are grown up enough to go to uni but lack the common sense needed and life skills to read usually quite simple documentation and / or feel they are owed somwthing.

    Not specifically related to the OP many others too (and I'm only 9 year out of uni) but I wouldn't even have considered it being unfair not to meet my financial commitments had I signed a tenancy agreement. I live with 6 others and it wasn't the best year of my life but I never even considered making that the landlord responsibility.

    Common sense would suggest the tenancy agreement would be the 1st port of call.

    OP has also failed to answer any question asked by others.
