my ex wifes debts--my problem????

hello
first time ive used this but myself and my ex wife have been divorced for seven years and she has now remarried and moved and i have also moved housed but recently i have started getting letters for her from debt collection agencys and i am worried how far these debts go back and if i am going to be liable for them or if she has put my name on anything and if i will end up liable for this if they dont find her???? very very worried as i am trying to sort myself out and trying to get a mortgage and get on with my life
please help

  • If you didn't have any joint debts or didn't sign anything to have your name put on it then I wouldn't worry. It looks like she's just trying it on. If they're in her name only they'e not your problem.

    Also - what are the debts for and how old are they?
    They could be statute barred if 6 years old (12 for property)

    If you do not think you are liable for the debt, ask for a copy of the CCA.

    Also if the debts were from longer ago than 7 years they would be statute barred anyway, assuming that you ex OH didn't contact them in the intervening time or acknowledge the debt. Often debt collection agencies buy old debts for pennies in the pound, and then try it on with people, in the hope that they won't know their rights and will therefore pay up.

    One thing you can do is to put a notice of disassociation on your credit file so you are no longer financially linked to her in any way.
