MCE Ins. wont honour NCB after non-fault claim

Evening all,
I was involved in a non-fault accident on my motorbike in July '17. The claim was dragged out by both party's solicitors, but I eventually got paid out by Part 36 offer and the claim was settled in full, by the 3rd party insurance.
The problem I have now is because it was settled by Part 36, the liability is still not in anyone favour. I was advised to accept the offer rather than take it to court, which I did. So my insurers are saying without liability, even though they paid out in full, I cannot keep my NCB as it's still pending.
Is there a way I can do about either; getting liablity after it's settled, or convincing my insurer that it is indeed settled and a non-fault claim?

Yes I did claim and no they weren't protected, but even MCE have told me I will retail the NCB as long as it's proven non-fault.0

After speaking with the Financial Ombudsman this morning, they advised logging a complaint with MCE before they can take any action.0

First complain to them (their complaints procedure will be set out in the policy docs)
Then if you are unhappy with the reply or they ignore you (for 8 weeks) you can escalate to the FOS for their adjudication0 -
Thanks for the clarification. Logged a complaint this morning and set out all of the information in an email, rather than it being spread out over different phone calls as before.0
