CPS vs AJH Films was about an employee/employer relationship. It has no bearing on your situation whatsoever. I would write back and threaten them with the SRA for giving out such misleading information.
It won't make it go away which you seem to be hoping for but it might dissuade them from launching a court claim.0 -
Indeed, I woudl ask them how this case - which was not attended so never defended properly - has ANY bearing?
It deals with the well trodden ground of Agency, and for them to state that Agency has any bearing here is laughable but more importantly is misleading to an unrepresented consumer
You require them to confirm they wish to yet again use this discredited theory of theirs, and you will have nmore grounds on which to complain to the SRA about their breach of professional ethics.
OF course they can withdraw this suggestion and your complaint will be a little shorter0 -

I have a similar question. I have appealed an NTK on the basis of late issue but they have responded with "the charge only has to be issued within 14 days if the operator wishes to rely on POFA. As you can see, there is no reference to POFA in the NTK, therefore the NTK is correct".
However, they are IPC accredited and the Code of Practice refers to compliance with POFA (though interestingly I cannot find reference to timescales for issuing the NTK in the Code). Surely they should therefore be complying with POFA?
I'm not sure how to respond now.
