PPI joint account

Hi, I have made a successful claim for PPI via Claim Guys, two of the accounts were in joint names with my ex wife going back to 1998. Halifax have agreed to split the amount equally between myself and the other account holder/ex wife. Fair enough, however the Claim Guys are asking for me to pay them their % of the whole claim to them even though I am only receiving half from the Halifax. I no longer have any contact with my ex wife. I have asked Claim Guys to amend the amount I pay them to reflect what I will actually receive from the Halifax. I have sent them a copy of the letter I received from the Halifax confirming the amount I will receive. Do I have a case here?
So far I have not had a response from Claim Guys either way.
Thanks.

No. You employed them, you need to pay the full bill.0 -
I agreed to pay a % on money I received not part received.0

I doubt you did. Check the t&cs. You would have paid the fee even if the creditor had set the whole amount against arrears.
But if you had an agreement that stated you would only pay on the amount you get, send them a copy of that.0 -
Either way we are talking a £240 to pay, not a huge amount on 7.5k return. I'll keep pushing it though.0

I've never heard of any CMC contract stipulating that their fee was based on money actually received rather than awarded.kompressor wrote: »I agreed to pay a % on money I received not part received.
Again, that doesn't sound correct. CMC's generally charge around a third of any redress (plus VAT). So where have you got the £240 figure from? Much more likely to be £2,400 (plus VAT) I'm afraid.kompressor wrote: »we are talking a £240 to pay, not a huge amount on 7.5k return. I'll keep pushing it though.0 -
There are seven accounts, two of which were joint. The two accounts in question will mean I have to pay £240 on top of the fee I thought I was paying. The total payout is approx. 7.5k fortunately most of this amount is coming my way minus fees to claim guys. Hope this is clearer to understand.0

So, as I said, you are paying a huge proportion to the Claims company.kompressor wrote: »The total payout is approx. 7.5k fortunately most of this amount is coming my way minus fees to claim guys.
I don't know why you are being so cagey about the total fees you will pay.
In the money-saving spirit of this website, stating the actual amount you are being charged should encourage others not to use any CMC for a simple and free complaint process.0 -
Not being cagey 30%, huge I know and to be honest these accounts go back to mid/late 90's and knowing what I know now with hindsight could have done better. I wasn't even going to bother until recently it's only being encouraged by my current wife I decided to look into it. You live and learn as they say. I haven't had a PPI in years and never will again and some of these accounts I never realised I did have PPI. We're talking 20 years back here.0
