Buying a house with a court order

Ask the court officials? They won't give legal advice, or personal information, but they can advise on procedure and timescales.0

It sounds extremely unlikely that a trial would take place so quickly, or that a trial for a case over a house would be done over the phone.
The hearing you have been told about sounds like it is just a 'case management conference' - i.e. the judge will set directions as to when the trial will take place, how long is required, how many witnesses are permitted are so on.
The CMC will not resolve the case, it is just the start of a much longer process.
Realistically you are probably looking at a few months for this to be resolved in a best case scenario, much longer in a worst case scenario.0 -
The one that wants more than the other is prepared to buy them out at your offer price.
They have agreed on a price.
what you need to find out is if thy can afford to do a buyout.
if they can then if you want to buy it you need to offer more.0 -
Hi,
After the statement of buying out the other, no vendor has actually proceeded in doing so at all. The initial court ruling took over a year but the outcome was that the house HAD to be sold.
Unfortunately the Estate agents valuation did not take into account factors that became apparent at the mortgage valuation.
The estate agent has even explained this now to vendors.
The vendor has assured me that it could ve rectified by taking control of sale but as mentioned before and answered 2 weeks sounds rather dubious to me, and by now im near end of my tether0 -
Just an update for all future people in similiar position. An actual court hearing was set and therefore not via phone or without the other party. one vendor wanted money outside the sale to proceed.
