Missing Memorandum of Staircasing
Bobetta
I bought a shared ownership property 15 years ago, owning a 50% share.
10 years ago, I bought the remaining share with a new lender.
I am now trying to remortgage and the conveyancers are insisting on seeing a Memorandum of Staircasing.
I don't have it in my records but I have lots of other letters/documents from both sales.
The Housing Association don't have it but said that they would have had it to proceed with the Staircasing.
The conveyancers from 10 years ago went into liquidation a few years ago.
The Land Registry does not have it.
The conveyancers are saying I can't proceed with the remortgage or sell the property without this doc. The HA are willing to write to the conveyancers to say I own the property but the conveyancers are not accepting it as proof!!!
I'd be really grateful for any assistance.

Find out which firm now has the files from the old solicitors and request a copy?0
-
No firm does now. The firm that uses the old firm's number says nothing to do with them, no paperwork left and to contact the liquidators if I'm looking for financial compensation.0

The old files don't just disappear...

Thank you. I have approached the SRA and I'm awaiting a response.
I the meantime, I have paid a conveyancing solicitor to look into this (£120). They have added a note via the land registry to say that my HA confirms I have staircased.
We are waiting to see if the mortgage lenders conveyancers accept this as evidence.0
