A family member is getting divorced.
He has been told that maintenance is no longer paid for ever and a day but that he needs to pay a lump, sum, something like four years worth in one go.
Can anyone shed any light on this and how does one raise the money to pay off the other half like that?
It’s quite possible he has got the wrong end of the stick!

In either case, he's absolutely dead wrong.0 -
No children. I thought it sounded wrong.
It’s a monthly payment for ever more then?
Is there such a thing as a clean break divorce?Norn Iron Club member 4730 -
No it is almost totally unheard of in the modern day.No children. I thought it sounded wrong.

Exceptions are often to do with disability or similar, but in essence there's no 'buying freedom' involved, nor ongoing support.
I would suggest he speak to a solicitor - spousal maintenance has been quite rare, atleast in the last decade!0 -
Surely there has to be one or th either! Buying freedom or ongoing support?
She is not working , claims to be unfit but has been turned down for PIP.
Thanks for your help, I’d like to be able to understand what way this goes.Norn Iron Club member 4730 -

Why would there be??!!
Women stopped being property a long time ago!
99,999/100,000 there is no maintenance payment of any kind, simply a split of assets.0 -
Even if one party has always relied upon the other for financial support?
This is news indeed, so it is a clean break.
I suppose I am thinking about my parents divorce in the 1960s and there were, obviously, children involved.
Final,question- I suppose the fact the she bet away ££££ has no bearing? It was “their”money I guess.
So, in a nutshell, she gets half of the assets plus half his future pension. End of, and has to either blag benefits or get a job.Norn Iron Club member 4730 -
No bearing whatsoever.Even if one party has always relied upon the other for financial support? - Yes!

I suppose I am thinking about my parents divorce in the 1960s and there were, obviously, children involved. - which is not really relevant to divorce as those orders (which wouldn't apply here, but just fyi) last 12 months

Not necessarily get half, but the starting point is 50/50. That's what marriage is. Other factors can be considered, but without children and both of similar age the split would be close to that.
Other consideration is length of marriage, if under 5 years, the parties are typically put back to the position they had at the time of marriage0 -
Yes there can be maintenance awarded my husband paid to his ex wife in a lump sum as it was only £200 a month. There is a very long post in MSE from a divorced man who is paying his ex’s maintenance monthly. It’s all down to what is agreed between the divorcing partners. Your friend needs a lawyer.0

JackRS's thread? Which he's finally paid off. In that situation though I believe the wife had a disability of some kind, Jack was also I believe quite well offYes there can be maintenance awarded my husband paid to his ex wife in a lump sum as it was only £200 a month. It can be awarded, but it is very, very rare.0 -
Thanks again.
Sadly, more like25 years of marriage.
He is seeing a solicitor this week.
Poor guy, she has spent all, their savings and contributed little over the years, but he was foolish and let her deal with the finances while he was abroad working hard.
There’s nothing much apart from a small house she lives in and a flat they rented out.both mortgaged. He may try to buy her half of that if he can afford it .
She stopped work, poor health, which is sad .Norn Iron Club member 4730
