Mortgage & Finances Seperation

I divorced in Sept 2015 and did this myself as I could not afford a solicitor and the court ordered my ex to pay half in the final agreememt - which he did not pay.
When it came to the financial seperation after a letter from my ex's solicitor I got a solicitor and they sent my ex husbands solicitor all of my information, but we got nothing back. I had to borrow the money to pay for this.
Since then my ex husband has been uncontactable.
We have no finances to split other than the house which is in joint mortgage names. The equity is near to nothing.
I am currenlty living in this house with our children and really need to sort the mortgage out for finance reasons. I cannot move, rearrange a new agreement on the mortgage or anything. I am stuck. The mortgage company have said they can put me on a better deal if my ex will agree - but I cannot get hold of him.
My query is if anyone knows how I can sort this out. I do not have the finances to hire solicitor and cannot get hold of my ex. I have been told all I can do is take my ex to court and this could cost up to £10k which I do not have.
I dont want to be stuck for the next 20 years in the house not being able to make decisions and have to keep paying for the upkeep or be in a position where I cannot negotiate with the mortgage company should I need to if for instance the payments go up and i cannot afford them.


Any help would be very appreciated

    Can't you trace him via his employer?
    Just to add, you won't be stuck in the house if the mortgage payments are not kept up.
  • I cannot trace through employer as he gave his job up in Oct 2105 and would not claim benefits so he didnt have to pay child maintance. I have contacted CMS and they have a flag on him so if he does start to work or claim they will know and can start a claim for CM if this happens. They cant give any details to me because of DPA
    I am hoping I can keep the payments up on the mortgage, at present I am able to do this, but my income may change over the next couple of months and I am worried re future and also not happy that he is not in our life but still is controlling the financail aspect of this. Also dont want the kids to go without.

    are you looking to remortgage in your name only or are you wanting him to sign up to a new joint mortgage deal? If he has no income, is yours sufficient to take the mortgage?
  • I have had a quote on a mortgage and can afford to remortgage in my name, lower payments so would put me in a better position. Just in my name.
    I need to financially seperate if possible from him. As far as I am aware he still has no income as the flag on CMS has not been alerted. but I cannot contact him to sort. And even if I could I dont think he would agree to anything just to be awkward.
