PRA group Barclaycard debt

I would think that keeping quiet while they are non threatening is the best way. They may never come back to you with documents, so by making an offer you would reset the statute barred clock.Lemonbelly wrote: »OK, nearly two years since i last posted here. I have not made any payments to PRA, i said their documents were inadequate ( not that i was really sure) I said it didnt prove any thing. I got a letter last november saying they were still waiting for the documents and meanwhile had deemed my account unenforceable. Since then i havnt made any contact but just recieve a monthly statement from them for the full mount and an offer for 20% off.
I was thinking of writing to them with a low offer but wondering whether its best tplet sleeping dogs lie and leave it. I dont really care about my credit file anyway. Is it unusual for them not to be able to find the documents after a year, i dont want to stir them up and encourage them to make the effort.

I have recently been contacted by PRA after defaulting a couple of years back on my Barclay card but still paying a minimal amount to keep them satisfied. Should I stop paying and not reply to PRA voicemail?0

From a legal perspective, you are not obliged to respond to texts/voicemails/emails or phone calls, all that matters is the written word, correctly formatted in a letter.ballnchain said:I have recently been contacted by PRA after defaulting a couple of years back on my Barclay card but still paying a minimal amount to keep them satisfied. Read through this thread, it may be old, but the advice still applies, once they do write to you, send them the provit letter.
Barclaycard have offloaded your debt to PRA, you can stop paying them now.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Why would you stop paying if you still owe the money?0

From a legal perspective, you are not obliged to respond to texts/voicemails/emails or phone callsYou may want to revise that idea an update it for 21st Century. People are paid to trawl social media.
- All land is owned. If you are not on yours, you are on someone else's
- When on someone else's be it a road, a pavement, a right of way or a property there are rules. Don't assume there are none.
- "Free parking" doesn't mean free of rules. Check the rules and if you don't like them, go elsewhere
- All land is owned. If you are not on yours, you are on someone else's and their rules apply.

They are indeed, but they must still write to you, a court claim, although processed online, must still be sent to the debtor in writing, so must a demand for payment of a debt, that requirement has not changed.Galloglass said:From a legal perspective, you are not obliged to respond to texts/voicemails/emails or phone callsYou may want to revise that idea an update it for 21st Century. Because the debt has been sold to PRA group, and there is no guarantee BC will pass on the payments, once PRA group actually write to the OP, they can then continue there payments, if they wish to.John_ said:Why would you stop paying if you still owe the money?I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Well you have two options -xcross1966 said:Hi please help I requested a copy of the credit agreement from PRA for a barclaycard debt and I received copy statements but no credit agreement - in the email PRA have said enclosed is information I requested should I ask again for the credit agreement? One is that you now ignore everything short of a court claim and if you do get one, defend on the grounds that it is unenforceable due to CCA s77-79.
The second (and II think i would do this so they know where you are with it) is to write and point out that no credit agreement was enclosed and that the debt is now unenforceable due to CCA s77-79..
I assume you're not paying anything to them.0 -
Thank you - i am paying DMP through StepChange since 2017 - I have paid over £3k to PRA - the barclaycard was opened in 2008
