    Dear Sir/Madam

I refer to your recent letter, in which you state you have purchased my account from Barclaycard, and confirming my repayments will stay the same as before.

I wrote to you in December to request a copy of the original credit agreement and a statement of account, in order to ascertain my position.
I have received a reconstituted copy of my credit agreement.

To date, I am yet to receive any copies of recent statements showing how the total debt accrued.
    .
I again ask you to comply with my original request, as per the consumer credit act 1974 sec 77/79.

As an aside, I have been offered a sum of money, by a family friend, who is willing to pay £1000 as full and final settlement of the account.

I am making this offer on the clear understanding that, if you accept it, neither you nor any associate company will take any other action to collect or enforce this debt in any way and that I will be released from any liability.
If you accept this offer, please confirm that you will mark my credit reference agency file to show that the above account has been partially settled and closed.

I can pay the amount I have offered within 24 hours of receiving your written agreement of this offer.

Please send me details of how I can pay.

Tidied it up a little, more concise and compliant with current legislation.
Also start at £1000, you can always increase it.
    SC

after nearly six weeks I have now recieved a letter back from them saying they enclose the copy of documents I requested. But they haveonly sent me copies of two different statements, one from 2014 and one from may 2017.
As i was making payments up until Nov 2017 shouldnt they supply statements to this date?
Are they obliged to do this.?
They request me to phone them within 10days to "come to a mutually acceptable agreement to settle the outstanding balance"
should I write back or phone and say they have supplied me with sufficient documentation?
    Please advise, thank you.

You're trying to settle for £1000. You can phone them to discuss whether they will accept that, but you need the final deal in writing.

If you're not confident, just write to them again asking them to respond to your offer.

But it is useful sometimes to have a phone conversation at this point.

i was meaning, should i write to them to discuss the point they havnt sent me an up to date statement, thus how the final amount has been arrived at. the only sent me a statement up until may 17, but payments were made to Bcard up until november 17.
  • I have recently received letters from the PRA group re my Barclaycard debt. The debt has now come off my credit file as my default has past 6 years. What powers do the PRA group have to chase this debt. I haven't made any payments to them as yet.

    Thanks

No one has any power at all.

They have the option to use the courts, just like anyone else has.

  • OK, nearly two years since i last posted here. I have not made any payments to PRA, i said their documents were inadequate ( not that i was really sure) I said it didnt prove any thing. I got a letter last november saying they were still waiting for the documents and meanwhile had deemed my account unenforceable. Since then i havnt made any contact but just recieve a monthly statement from them for the full mount and an offer for 20% off.
I was thinking of writing to them with a low offer but wondering whether its best tplet sleeping dogs lie and leave it. I dont really care about my credit file anyway. Is it unusual for them not to be able to find the documents after a year, i dont want to stir them up and encourage them to make the effort.
    thanks for any advice
