Neighbour extension built over boundary

    The driveway in front of the garage is 30ft long, so he has taken that 6 inches for the length of the driveway. The driveway width is fine for cars but is very tight for a flat bed truck, that extra space could make a difference.


    I probably will forget about it but why should people do what they want, break rules, just because it makes things easier for them?

    Perhaps it's a genuine mistake or that's actually where he believes the boundary to be.

    Also, just because it's in the wrong place at the garage, doesn't mean it's in the wrong place 30ft away down the drive.

    Fact is, neither of you can prove where it is either way, certainly not for the sake of 6 inches. If you blew up the Land Registry title plan to full size, the red line would be about a metre wide, so how it's supposed to accurately show 6 inches, I don't know.

    I can do exactly the same with my neighbour who is a bit obsessed with us stealing her land, although we've changed nothing in the 7.5 years we've been here and our predecessor clearly did nothing for a very long time indeed. Our boundary marker, for pretty much ever by the look of it, has been a hedgerow, so how she knows where the boundary is exactly, I have no idea, although she thinks it all runs on 'our' side of the massive trees that she claims ownership of and aren't quite as small as they were when planted and so don't even line up straight. Really, who cares though? All it does is make her angry about us, and presumably about life in general for literally no reason at all. She has half and acre and over half of that is scrub.

    Don't be my neighbour. She's clearly not happy, because her mind tells her to make unimportant things important.

    Because they can.

    However, you had the option to accept what you saw, negotiate on the matter, or walk away.

    You chose acceptance. Now your choice annoys you, but your neighbour has no control over your thoughts, so the solution is clear enough.

    You are correct in that we did accept what we saw. I would say though that we didn't notice it at the time and it wasn't picked up on the two surveys that we had done. I would also say that it is clear where the original fence post was fixed to the wall to the rear of the garage.


    I also have the planning drawings for the garage that was built 30 years ago. It shows the guttering and concrete base being inside the fence line. There is a note saying about the 6 inch gap between the garage wall and the fence.

    So, what if the previous fence was in the wrong place or the previous owners placed a fence inside their own boundary, which is what people often do? There is no requirement for a fence to be on or straddling a boundary.

    The garage isn't original either, so
    - the previous fence could have been within the neighbours boundary
    - the plans will take no proper account of the actual boundary, only the fence line at the time. Boundaries are not checked at planning.
    - the garage could be built not according to plan

    I'm not saying you are wrong, but the boundary line is not categorically defined as a fence because a physical boundary has no actual dimensions, whereas a fence clearly does.

    In summary. The boundary has no dimensions. The title plan itself is not accurate. Planing drawings of later extensions cannot therefore be accurate. Builders are often not accurate. Peoole can put fences wherever they like, not on the boundary. New owners have different opinions to old ones.

    So there is no proof of anything at all. Choose your battles.

    So in summary, when it comes to boundary lines nothing can be proven. Stick your fences wherever you like!

    Two ways of thinking about it, Live and let live would be the other.

    The primary aim of property registration is to mark out your house and the vast proportion of your land to give you security. The last few inches on the detached side of a house are de minimis in the grand scheme.

    It's better to remember that, and all the things you do have, than to focus on the perception of something you don't have that actually has no impact on your life.
