Should contract state hrs/days of work/days off?

Hi all,

Just after some advice re my contract of employment. It states that I work 40 hours per week but that these will be flexible. I have no core hours or specified days off and am basically on call 24/7.

Do I have any right to ask for specified days off per week or at least to know what I will be working with more than five minutes notice? It’s impossible to arrange childcare and my relationship is suffering so any advice would be welcomed

    No, no rights to set days off. You can ask, but if flexibility is expected then any attempt to restrict this is unlikely to go down well.

    EWTD says you get:
    • at least 11 hours continuous rest in a 24-hour period
    • a 20 minute break after every six hours worked
    • at least 24 hours continuous rest in a seven-day period
    That's it really.

    Just for clarity.... No, it doesn't. It certainly doesn't say that you have a right to a 20 minute break after every six hours worked. It says that if you work six hours or more, you are entitled to one break of 20 minutes which does not have to be paid.

    As for the rest of it, there are exceptions. Without knowing the job done, or the conditions, then there is no way to know whether the OP falls under those exceptions or not.

    48hr break in 14 days is also acceptable.

    Which allows for 2off 24on 2off.

    Asking for what the notification will be for shifts is fine, it doesn't mean you won't get any notice - we are meant to get 6 weeks notice, it's often less than that (but we get 4 weeks at a time, so may have 2-3 weeks on one week but 6-7weeks on the last week) so you can arrange child care

    Negotiation can work with reasonable employers.

    If not there may be other options to stop late notice.

    Depends on how you get notifications.

    Eg. If by phone turn it off.

    It’s just ad hoc, I never know what I’m doing until the actual day which is why it’s so hard to get any childcare as there’s no consistency. My partner works shifts so it’s a constant juggle. I’m basically just at their beck and call and I can’t ever say no
