PPI payout "without admission of liability"

I recently read Martin's advise and pursued a claim for PPI comission/Plavin...it looks like we could be clawing back several thousand pounds..it has not happened yet and I don't want to jinx it!

Anyhoo, HSBC had previously stated that I had no PPI claim despite my providing paperwork dating back to 1995 and statements proving that they only stopped taking premiums in 2012 when we asked them to stop in the wake of the ppi scandal. They initially fobbed us off stating that the PPI started too long ago and that it was with Capital One which HSBC aquired in March 2003.

HSBC's offer is made "without admission of liability", does this preclude me from now going after the rest of what could be owed ie mis-sold PPI that was "out of date"?

Either way, thank you and thank you again, have slept properly for the first time in years...we probably wouldn't have bothered if not for Martin Lewis's advise, we were so sick and tired of being knocked back...:money::money::money::cool::cool::cool:

    What was your specific complaint and what did they reply to that point? Proving payments stopped in 2012 isn't a complaint reason.

    I think you should assume that whatever offer you get is a full and final settlement. If you choose, you can reject it and go to FOS in the hope of more.

    Hi,specific complaint was that we were mis-sold in 1995 when buying a car using finance/Capital One CC and continued paying years after the car was long gone..it was never properly explained then the garage when out of business.

    I'm confused by this.

    Was the PPI sold to you by the garage when you bought the car?

    Or was the PPI already on the card which you used?

    The garage somehow arranged for you to receive a credit card? That doesn't sound correct.

    The whole cost of the car was paid for with a credit card? Surely not a very cost effective way of financing?

    Assuming the PPI was on the credit card, it would of course still continue after the car was paid for. However, you'd only pay PPI when the account had a balance..

    So your PPI complaint has been rejected and you have received a Plevin refund of undisclosed commission. Plevin only applies to rejected complaints and is not an opportunity to re-state your original complaint I'm afraid.

    Yes.
    Your original complaint was rejected (not fobbed off) and you have no further recourse unless that rejection was less than six months ago, in which case you can refer your case to the Ombudsman.
    If your original complaint was rejected more than six months ago, it is now concluded.
