    If they knew about it surely they would have made some mention of it during the last two years that benefits have been claimed. My theory is they don't.

    But you said the money was paid into his account in December and it was this I meant they may know about - do you think the suspension is a coincidence?

    For someone who claims to know 'not nearly enough' you seem to have a lot of the facts.

    Don't they have internet banking? Can't they print off a statement showing the withdrawal by cheque?
    Unless I say otherwise 'you' means the general you not you specifically.

    I have been shown the relevant letters. Personally I am fortunate enough to have never been on benefits so have little clue what any of the terms mean or how the system works.

    The letter from the borough benefits office says:

    "DWP have told me you are no longer receiving a DWP benefit or tax credit. We no longer know what your income is so we have suspended payment of HB and ended your entitlement to CT Support. Id you want to continue claiming HB and/or CT Support please tell us of your new income on the attached form"

    Meanwhile the Tax Credits letter says

    "Why we are writing to you.
    Your tax credits award has ended because a Tax Free Childcare account has been set up for you. No further payments of TC are due for the period"


    To me it sounds like a coincidence that the letters were issued roughly the same time as the deposit.
  • If the Bond was in the name of the son why was the matured Bond balance paid to an account in the mother's name? I assume it was paid to her account (or a joint one) otherwise why would she have been the person "mistakenly" paying it to him.

    Was the Bond one where interest was rolled up over the term or was interest paid out annually? If was paid out annually, HMRC would have been advised by the financial institution of the payment and to whom (the name) it was paid.

    I do hope that the mother is not herself in receipt of means tested benefits, as putting a £60k bond in her son's name may be viewed as deprivation of capital.

    The mistake occurred five or six years ago when her money was put into a bond in his name. It matured recently and was then paid into his current account.

    How was the mistake made in the first place ? You say here it was paid in to their account and was in their name but in the first post it states the mother transferred the money ?
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    TELLIT01, I understand all you say. My question is, does sending in recent statements (but not the most recent month) fall under the category of "disguising the facts"? Would it be viewed suspiciously by the benefits office?
