I don't understand this: The new firm causes you concern because of their reviews and you don't know your rights and "terms and conditions seem to change".

The other local firm has "crazy return policies".

What are the "crazy return policies" and is it more unsettling that the new firm's seem to change?

    theonlywayisup....

    your replies are kinda odd!!!
Did you even read what I posted???
I am honestly not trying to be rude btw but you don’t seem to have followed what I have said at all.
As a suggestion, in order for you to understand, maybe slow down and re-read my post and hope the fog clears a little for you.

    For your benefit.....
My post refers to 1 negative review for 1 specific item only. they sell numerous other items...madness I know!!

Apologies for you not understanding why I do not know my rights...I will try to do better in future!!!
When you do re-read, I stated that I thought because the new company is online sales only, then the term(s) and conditions change...as opposed to if I was buying from a store, over the counter, face to face!!!
What are the crazy return policies??? Have you never dealt with a company that seems to have “crazy return policies”???? If not, then lucky you my friend!!

I am still trying to work out your reason for asking ...“Who is "the reviewer"?”

voyagar2002 unholeyangel ....thank you for your reply.

[FONT=&quot]To clarify, I am the consumer. The items I will be purchasing are for use in my own garden.
I am a retired Butcher, not a builder hehehe

I think the thing I am most concerned about is exactly what to do if I receive an delivery and only a specific item in that order is below standard. I just happen to be talking about some wood in this case but it could be anything.
If something being delivered has sustained damage during transit then thats easy...you just refuse delivery!!!
But if something is on sale and the item arrives below reasonable standard, do my consumer rights allow me to reject that part of the order.
eg. I order a number of items (screws, nails, hair gel).... One of these items are lengths of wood which are stock standard, listed exactly as it would normally be listed(ie no damage or poor condition issues)...the only difference is that the product is on special. The order arrives and whilst unloading, I notice the wood is seriously inferior and full of holes (not due to transit damage).
The driver isn't going to hang about while I speak to the supplier so what should I do???

    Wow.

Don’t trust in trustpilot, there may be many more negatives that have been removed

What are the crazy return policies of the other merchant.

If the other merchant lets you see the product before you purchase their crazy return policies should t matter.

I know who I would use

Much better to get a decent product in the first place rather than rely on rights that may be difficult or impossible to impose

You probably need to look at the practicalities of this.

First you need to check their t&cs to see if they sell to consumers (if not, by ordering you may be agreeing that you are a trader and not a consumer.)

If they sell to consumers and you are a consumer, in addition to any terms they state, the products must be:
    • Satisfactory quality
    • Fit for purpose
    • As described

Then, for example, you may feel that the products delivered are not of satisfactory quality. But the company might disagree, and they already have your money.

You might be able to make a section 75 claim from your credit card, if a single item costs over £100 - but the CC company will want you to instruct and pay a 'wood expert' to write a report saying that the wood is not of satisfactory quality.

Alternatively, you can take them to the small claims court.

To be honest, if you suspect that their products may not be good, and they have a bad returns policy - it's probably best to buy elsewhere, rather than risk having to go through the hassle mentioned above.
