No MOT at time of car crash

Hi everyone

I was on a car crash last week. Unfortunately the cctv footage which would show that I am not at fault will not be released by ALDI :(

Anyway my real concern is the following... when I went to check when the tax was due on the Gov website I also saw our MOT had expired in dec 17. Called DH as he had taken the car in for a service and MOT in December... turns out they had written service down and not done an MOT. As soon as we found out (Wednesday night) we booked the car in the next morning (Thursday) and it passed.

My question is, do I need to inform my insurers? I’m worried about it voiding my insurance? It didn’t have an MOT at the time of the crash but now it does. Any ideas on what I should do? We se tearing our hair out over this!!!

    If it passed with accident damage don’t worry about it.

    Not having an Mot does not void your insurance. It’s likely a condition that you have to tell them, best to check your policy. There is also the possibility they will check themselves.

    You will have 3rd party cover as a minimum, they can’t get out of that but they may be difficult about paying out for your damage if you are deemed at fault.

    So hang on dont you think that the garage not supplying you with a MOT cert at the time may of roused on your part some suspicions that something was adrift. Personally id just keep quiet. Aldi will only release any footage if the plod ask them for it. Its mad someone hit my car in a car park and drove off i was told clearly evident on CCTV yet they wont release it showing me the offending cars plate etc under data protection.

    Your insurance is not voided at all.

  • Lack of MOT voids insurance-that old chestnut once again.

    As posters before have stressed it doesn't.

    Without MOT you are legally entitled to drive to a pre booked MOT test. That goes as well if the vehicle is on a sorn.

    MOT certificates haven't existed for over half a decade. You get a basic printout of the results but there's no longer such a thing as a MOT certificate.

    Don't complicate matters. It's a sheet of A4 that says "MOT Test Certificate" at the top of it.

    And, yes, the OP probably should have wondered where it was when they picked the car up from the alleged test that never happened - or even wondered why the test fee wasn't on the bill. But for the purposes of their question now, it's unimportant.

    Not having a test will not affect their insurance.
    It may affect their payout if the car's written off, but if the car has since passed a test, it shouldn't.

    They can release it under the DPA, as there is an exception for any prospective legal proceedings, which would include taking legal action against the other driver to recover your losses if they deny responsibility. However, the minimum wage slave at Aldi will simply parrot the "Can't release it under DPA" line, as they aren't paid for initiative, only to follow orders.

    Your insurance can request it, but they won't bother as anything they pay out they get back off you anyway.
    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    (except air quality and Medical Science ;))

    That would only be in the case of a write off, and 10% off the value of the car.

    Should have no effect on the damage cover.

    Write to the information Commissioners Office to ask their opinion of Aldi refusing to release footage of you which they are holding.

    And of the other scenario mentioned in this thread of refusing to release footage of your property being damaged by a third party where you yourself are not in the footage.

    I would inform Aldi (in writing to head office and cc to the local branch manager) that you intend to make a formal complaint to the ICO and they are required not to destroy the footage that they have in the meantime.
