Unless Indigo passes it back and a magistrates Court case arises just how do you go to the court to appeal further? I can just imagine the scene.

No no. Obviously, you have to prosecute yourself.
It's a great idea. It sounds like it might be a bit energetic, leaping backwards and forwards from the dock to the well of the court - specially when you are cross-examining yourself. But it doesn't' have to get that far. After you've presented the case for the prosecution you simply make a submission of no case to answer. Job done.0 -

well it seems that indigo may be telling one department in the DVLA some "porkie pies"

Maybe they meant to say " for a number of days" rather than "for a number of months". Easy mistake to make. I've asked the DVLA to investigate."

"In an email dated 24th January Glenda Hire of the DVLA told me:
!!!8220;Indigo Parking have advised that they are not and have not for a number of months been requesting data whilst they are investigating this matter
The Indigo we are talking about is Indigo Park Solutions UK Ltd (previously Meteor) who manage railway station car parks, mainly those operated by Govia-owned TOCs - GTR (Southern, Great Northern and Thameslink), and Southeastern.
The matter we are talking about is Indigo mixing of Byelaws and contract enforcement. I complained back in 2016 about Indigo signs, which give the false impression they have the power to impose penalties for breach of the Byelaws (only the Court can do that). I also complained that whilst their signs all scream Byelaws enforcement, their windscreen tickets tell you its a contract matter: by entering this car park you have agreed and are contracted to be legally bound by those terms and conditions. Indigo refuse to clarify the legal basis for their penalties.
Anyway, it soon became evident that Ms. Hires information was false: Indigo Park Solutions actually made 877 KADOE requests in December alone, and NTKs are therefore still being sent out as normal. I reported back to the DVLA and yesterday got their reply.
As previously advised, Southeastern Trains have not been recovering penalties for some time. Indigo have made enquiries for other customers during the period.
Well I love cryptic clues but for the life of me I cant see how Indigo are not requesting data!!!; can turn into Southeastern have not been recovering penalties
Yet another example of the DVLA !!! absolute determination to let the PPCs do what they like. It doesn!!!;t give a lot of confidence in the success of the new CoP, which will be entirely reliant on this lot to give it any teeth. "Save a Rachael
