Parking Ticket blew over on dashboard - HELP!
Atwitsend
I purchased a parking ticket for £1 to park on private land for up to 4 hours. I placed the ticket on my dashboard on the driver's side. As it was a particularly windy day, I checked as I closed the door that it was still in place. I got my stuff out of the boot and then went into the gym. I returned an hour or so later, I found a parking charge notice on my windscreen. I was bewildered as I had obviously paid to legally park there. I then realised that the ticket had obviously blown over and landed upside down on the passenger side of the dashboard. I appealed to Corporate Services who issued the Parking Charge Notice enclosing a copy of the valid parking ticket. They refused this as according to them, the ticket had not been clearly displayed. I then appealed to POPLA who also refused it as it was not clearly displayed. I originally got the ticket in July last year and did not hear anything further after my two appeals until September when Corporate Services sent me a Parking Charge notice for £75. This morning I received a letter from debt collectors asking me to pay £135.00 and have given me until 6/2/2018 otherwise they will recommend to their clients (Corporate Services) to take court action against me. This is all for a £1 parking ticket that I actually paid and displayed correctly but through an Act of God, it got blown over to the other side of my dashboard. Can somebody please help and tell me what to do and if it does go to Court, would I be able to argue my case? Thank you!!

This is a scam.
Were they to take this to court it is likely that they would crash and burm. Judges are getting tired of PPCs asking outrageous sums for flipped tickets.

Everyone is politely asked to read up on this in the Newbies FAQ thread near the top of the forum
Go there now to learn about the game you are now caught up in
You can safely ignore debt collectors letters..
Ignore everything except a lbcca or proper Court correspondence
Throughout here you are advised never to reveal who was driving.
You need to edit your post to remove details of who was driving0 -
will recommend to their clients (Corporate Services) to take court action
The key is "will recommend". They don't get paid if they pass it back so as The Deep says it is a scam.
Corporate Services don't do court either - and you paid. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -
Yes, this is pretty weak for a "breach of contract", but then, so is attributing one's laziness to an "Act of God"...

Hello, don't really understand this response. I was happy to receive your advice and shall now wait to see if I hear anything about further action. As advised, I will not respond to debt collector's letter. I welcomed the advice you all gave me. Confused - what have I done wrong??????0

And you state for starters. . . . . ????? What else ????? I thought it was the place to come for advice?????0

In your original post, you reveal who the driver is, which is never a good thing.
You've been advised to go back and edit the post so that you don't reveal who the driver is.
You haven't done this.
I've been where you are now so I understand how you're feeling but the posters on here are trying to help you.
Please amend your original post. Read the Newbie thread again (I had to read it several times) and you'll be able to see what to do next.0 -
Debt collectors are harmless, they can’t take you to court, they can’t come knocking on your door, they can’t take your telly, they can’t clamp your car ........ in short they are powerless. This morning I received a letter from debt collectors asking me to pay £135.00 and have given me until 6/2/2018 otherwise they will recommend to their clients (Corporate Services) to take court action against me.
Corporate Services have the capacity to take you to court........

...... but are highly unlikely to do so - sleep easy.
You are at a recognised stage of the private parking pursuit continuum - debt collector stage. We have a specific section in the NEWBIES FAQ sticky - post #4. Go read it and learn how utterly impotent debt collectors are. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
