hi i will be renewing my mortgage in may 2008 and want to sell and buy another property.
my question is i have 2 defaults on my credit file that are incorrect one from o2 which says i owe them £369 i have contacted 02 who says i dont owe then anything and default should never been issued but still having problems getting them to remove this from my file.
2. abbey says i owe them £522 i dont i owe then 240 which i have offered to give them.. they did not issue me with a default notice and i have written to them on several occassions to which they have never replied they totalling the 522 as charges but am refusing to pay this as it was agreed i would pay the 24o and all would be ok... and no default would be added....
i know this will affect me getting a mortgage can anyone explain what would happen and how else i can get those removed as dont want to still have these when i remortgage experian has told me that the bank has boobed but seem to be getting nowhere with them

The ease at which companies are able to put items on peoples credit files is a real problem. They don't even have to TELL you about the debt, nor do they have to PROVE the debt EVER EXISTED in the first place.
The same applies to selling on debt... companies can and do sell on debt to recovery agencies without telling you it exists. Those companies will then demand payment and if you ask for evidence of the debt, refer you to the original company. It's a HIGE legal black hole IMHO that needs to be shut permenantly.Bankruptcy isn't the worst that can happen to you. The worst that can happen is your forced to live the rest of your life in abject poverty trying to repay the debts.0
