Inheritance help

Right so my son inherited a bungalow and all other belongings at the age of 15. All assets were sold and the money put in trust with 2 executors (family lawyer and family friend of the person who died) it was stated in the will he should get it at 18. My son turned 18 on 13th December last year. We heard nothing from any of them and so my son messaged the family friend as he’s never had contact with the solicitor who told him the lawyer should have wrote to him when he turned 18. The family friend contacted the solicitor who said he would send my son a letter to sign to say he wants the trust transferred to him and took his bank details. We have still heard nothing. No letter or details on the trust.

My son naturally wants access to this money (it’s a significant amount) he wants to put some away for a deposit on his own place and he wants to do his driving lessons and SIA course and license as that’s his career plan.

Are they right in taking so long?
What can we do?

    What can we do?
    No good reason as far as I can see. Get your son to write by letter to the solicitor asking for the mony without delay.

    We don’t have the solicitors details they have never contacted him all contact is through family friend.

    I would have expected the solicitors to be in touch.before actually handing over the funds they are likely to need proof of your son's ID etc, and I think they will probably have to file a tax return for the trust and then wind it up formally, so there may be some delay before he actually get s the money (or all of it) but in the mean time, ask the friend for the solicitor's details and contact he solicitor directly.

    (he could also get a copy of the will via the probate office which should tell him who the solicitors are, if the family friend is slow getting back to him)

    All tax should have been done on sale of property. Only fees would be if the moneys in an ISA and needs paying early release. Terms of will stated to invest to gain interest till he turned 18 but they left it till about a year ago when they toyed with the idea of an ISA.

    That’s only info we have been told.

    Il look into probate office.


    I understand it might take time to transfer money it’s more the lack of contact to actually sort anything.
  • Is it normal for a will to say who the solicitor was that drew it up? My late father's will doesn't say who drew it up and I have no idea who his solicitor was. Is there any other way to find out who the solicitor was?

    Probably yes. We still have no details of what’s going on. The family friend refuses to give the solicitors details saying he’s not allowed till my son has signed the paperwork. He used the words not legally allowed to till he’s no longer executer.
    He also says there was a problem with the account so solicitor is sorting it tomorrow.
    Any time my son messages the executer he calls him giving excuses meaning no paper trail either.

    I’m not sure if as an executer they had the ability to do something that could have tied up the money and are now worrying as my son wants it.

    We are going to find out details and seek legal advise as I do not trust this family friend.
