Hi looking for some help on employment law or experiences of returning to work on a phased return, i was basically injured at work through an accident whilst working, my index finger tendon on my right hand ( i am right handed ) was ruptured and needed surgery.
i had the operation and 9 weeks recovery now my surgeon/specialist has advised a phased return to work would benefit me to help gain stength in my hand.
i am salaried employee and we get our sick pay paid by wpa and receive 13 weeks at 100% and a further 13 weeks at 60% of pay, on returning to work on a phased return wpa are no longer managing the claim, i have returned to work after talking with my manager who simply said arrange with my line manager a suitable plan to help me get back into the routine, we deceided on 30 hours a week for the month of my sick note, there was no formal interview or anything put into writing or discussed with management or payroll , i have just received my 1 st pay ( paid 2 weekly ) and i have been paid sick pay at 60% of my wage. i could have received this sitting at home for a month ? i was under the impression i would be paid for what i did and paid sick pay for the time i wasnt there again nothing was mentioned of this, and i idid not sign a consent form to have my wages deducted this way can this be classed as an unlawful deduction of wages ?

However it seems that 60% is less than what you'd expect to get at 30 hours per week (closer to 75% presumably)
It sounds more likely to be an admin error.0 -
Payroll closes on a Monday for the prior two weeks, paid on the Friday of that week my pay day was last friday the 19th i actually started back on the 3rd January, so i am now into my third week of the phased return to work if that makes sense ?0

Not an error that was my argument why pay me 60% of pay, it is showing as sick pay on my slip but like you say i am working our week is based on 45 hours but we work on average 50-55 week we dont get extra for working over so why dock my wages for working under ? thanks for the reply..0

That aside, it sounds like the wage you received is close to what you expected at 45 hours per week (66%)0 -
Yes i understand that sort off, My Query was mainly due to them deducting my wages without prior notice.0

You surely didn't expect to be receiving a full time wage when working part time hours did you?0

It certainly seems odd that they would continue to pay full pay if you stayed off sick, but reduce your pay when you are returning to work. I would suspect a communication breakdown in the company. Maybe payroll have simply been told you are working 30 hours per week, and nothing about a phased return to work. Or possibly it's a situation they haven't experienced before and simply don't know how to handle it.0

Am I missing something here?
As a salaried employee I'd expect to be paid my full salary on a phased return to work. Is the OP not "salaried"?
Also sounds like a simple payroll error/timing issues/miscommunication etc.0
