    That’s definitely external damage, not internal. How was it packaged to be sent?

    I didn't see the packaging myself, but my Dad said UPS brought their own packaging, which was a box with a shelf that then went into an envelope.

    In a crazy bid to make money Samsung made more than one of these phones. Crazy as it may sound they even all look the same, you think it's possible that they may think that could be any ones phone?


    Photo's prove nothing, dates can be altered and one looks the same as another. All they see is a broken phone, they are not crooks.

    But why on earth would I or anyone think they could get a cracked screen fixed under warranty?

    What would we achieve by getting a cracked screen fixed? We'd still be left with a phone that doesn't work!

    I also contacted them with details of the fault before hand, so me sending a phone with another fault, a massive crack across it doesn't make sense. It's not like I could have tried to hide a crack or hoped they just wouldn't notice!

    This might sound crazy too, but I am actually telling the truth.

    Send them a LBA and see if they're that confident that a judge will believe the phone was damaged when sent. Perhaps remind them that making a false statement with the intent to gain or cause another a loss would be fraud and that they should consider very carefully before making accusations of criminal wrongdoing based on nothing more than presumptions made by them with no consideration given to any failure by one of their agents/the service they were providing (such as inadequate packaging since they supplied it, or if their courier packed it, perhaps dropping it during the process/not securing it leading to it falling out and being damaged during transit).

    I know the photos aren't proof to bris - who seems to prefer absolute proof. But neither criminal nor civil court requires absolute proof. Civil law is balance of probabilities and courts tend to take people at their word unless there is significant evidence to the contrary and it is relevant to proceedings. If there is evidence supporting one story over another, they will lean in that direction.

    I mean what their repair centre can attest to doesn't say one way or another what condition the phone was in when it was actually handed to their agent (courier).
