SIP Parking CCJ Set Aside

Newbie here looking for some advice. So a few months ago I was doing some credit checks as I am currently looking at renting my first property and seen I had a CCJ from SIP Parking. Now the back story to this was due to a parking ticket for my vehicle which at the time I had actually paid for the days parking but mistakenly entered one letter wrong when paying for the ticket as the car was new to me. I have checked my parking records on my phone app and this happened for around a week or two before I noticed and changed the information. So the parking company still got paid for the time my car was parked but on this day gave me a ticket. I sent a letter along with print outs of my purchased ticket to the head office in Manchester and received no response so thought nothing of this, little behold I have gone onto my Noodle report and there is a CCJ on the account. Once I got notification of this I set up a payment plan to pay the amount although I think this is ridiculous, I have not had the spare £255 lying around to pay the set aside fee but now I have this what is the chances of having the CCJ set aside?

I have all the evidence of my payment of the parking fee for the day when I was ticketed except there is on letter different to my car reg at the time and have full records after that of paying once the letter was changed this goes on for months.

This is going to ruin my credit score for absolute no loss to SIP monetary wise on the day they ticketed me.

    The Court will take the view you have known about the CCJ for months and now want to set it aside to "launder" your credit files.


    To be successful with a set aside application you need to apply as soon as possible after discovering the CCJ on the Register


    You don't say how you got this without knowing about a court claim against you?

    I do not want to " Launder " my credit file in anyway. When I first received the Parking notice I prepared my letter and copies of purchase of ticket and sent them to the parking companies head office. I heard nothing for weeks. I received a few letters from Gladstones and ignored these ( Regrettably ) and thought this would soon stop as they had been provided with evidence of payment and a clear letter regarding this. I received no official letters from the courts to say a claim was lodged against me and if I would have done, the evidence I originally sent to the Parking company would have been sent to the courts.

    I understand regarding this needs to be applied for as soon as possible from receiving a CCJ but I did not have the money at the time to pay the £255 fee. Hence I set up a payment plan for the CCJ to be paid so atleast this could be marked as satisfied on my account until I had the spare money to have a set aside tried.

    I cannot see how my credit file can be ruined for 6 years over a simple genuine mistake which I notified the parking company about the same week as the ticket, I am now having to pay £260 to SIP, which I cannot see in anyway possible is justifiable as I paid for my car to be parked in the first place.
  • If needs be I will pay SIP the money they want and try to arrange a set aside by consent if possible. Yes I am annoyed regarding the action they have taken when they got the parking fee in the first place but if my only hope is a set aside by consent then I am more than happy to go with that.

    I just dont want my credit file ruined because of a genuine mistake of a letter on a parking ticket.

    your credit file is already ruined for 6 years if you do not get a set aside , so you should have paid the £255 fee and done so

    paying it off means its deemed as "settled" , but does not expunge it from your credit record

    the consent idea might work
  • So is this case even worth contesting or shall I just accept for 6 years my credit is ruined because of a genuine mistake with no monetary loss to either side at all?

    A set aside by consent costs "only" £100 court fee if you are happy to pay off the ccj and would be a better option in your circs.


    But if you have stopped paying your instalments then act fast as they may go for enforcement (eg bailiff/attachment of earnings etc) - the costs of which would all be down to you

    You got this for not dealing with the claim rather than anything concerned with the merit of the claim!
