ukpc have cancelled my parking charge

parking charge date was the 12 dec 2017
100 pound parking fine letter recieved 11 jan 2018
reason for fine vehile owner / driver left site
location solatron retail park Farnborough gu14 7ql
should I appeal or pay the fine ??? visited shops on retail park then went offsite for 20 minutes to asda picked up a few items brought nothing at retail park as didn't see anything that I wanted too buy lots of people have said ignore all letters from ukpc is the right thing to ?
been on there website also to look at the pictures of my car the notice charge was three quarters up the window well as the picture show this but I did not see this until I used my wipers and they must have moved the notice after picture was taken to put the charge notice under my wiper so I did not receive the original notice that was first put on my car , so the only letter ive received is the one that was delivered to my house any help on this matter will be much appreciated ...thankyou

    Also edit your post to remove information about who did what. Only refer to The Driver and The Keeper.
    This is the normal starting point until you fully understand the scam. Mostly it is better to appeal as keeper, but in certain circumstances it is OK if the scammers know who was driving.
    Most NEWBIES don't know the drill, so we advise posters to default to keeper only.

    In your case it probably doesn't matter as long as the driver doesn't admit they left the site.

    If the keeper appeals, the chances are they have no idea what the driver did, so they simply ask the scammers to prove their case, which they won't be able to do.
    As advised above, appeal using the BPA template in blue from the NEWBIES thread. If/when they reject it, you make a second stage appeal to PoPLA where you will kill this if you follow our advice.

    There are only two initial appeal templates in the NEWBIES. The one you want is blue, and marked for BPA members.

    I challenge this 'PCN' as keeper of the car.

    I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs were not seen by the driver, are in very small print and the terms are not readable to drivers.

    There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.

    Should you obtain the registered keeper's data from the DVLA without reasonable cause, please take this as formal notice that I reserve the right to sue your company and the landowner/principal, for a sum not less than £250 for any Data Protection Act breach. Your aggressive business practice and unwarranted threat of court for the ordinary matter of a driver using my car without causing any obstruction nor offence, has caused significant distress to me.

    I do not give you consent to process data relating to me or this vehicle. I deny liability for any sum at all and you must consider this letter a Section 10 Notice under the DPA. You are required to respond within 21 days. I have kept proof of submission of this appeal and look forward to your reply.

    Given it is the only blue appeal, yes. Notice how it tells you to put in your personal details....

    so at the end of that appeal I put in my real name and my full address details ?I didn't buy anything from any of the shops in the retail park so I cannot add these to my appeal
  • reading this appeal letter ,,the signage was clear in the retail car park........even thou when they took the pictures of my vehicle the penalty charge was up high on the drivers side ,but was then moved to under the wiper should I add this into my appeal letter also???
