Glasses hometrial fiasco – may be charged £69 for not returning, what are my rights?

Hi there money savers, I've got myself into a bit of a conundrum and was wondering if anyone could give me some advice?

A while ago I ordered a glasses try-on home trial from two different companies, one from 'Glasses Direct' and one from 'Ace & Tate'. They arrived at roughly the same time and when I was finished trying them on I sent them all back. The problem is, I accidentally sent one of the 'Glasses Direct' pairs to 'Ace & Tate' and one of the 'Ace & Tate' pairs to 'Glasses Direct'. Silly mistake to make I know but hey ho.

Obviously the problem now is that Glasses Direct have been in touch to let me know that they're missing one frame. I will be charged £69 if I don't send it back to them within two weeks. I've tried to speak to Ace & Tate to get the pair back from them but they can't find it in their distribution centre.

Although I have made a silly mistake I am annoyed that I may have to pay £69 for the missing pair, it's not like I've done anything malicious here and chose not to send them back, it's just that the other company can't find the missing pair.

Do I have any rights to request the 'Glasses Direct' property from 'Ace & Tate' or anyone have any ideas how I resolve the situation? Many thanks.

'Glasses Direct' have sent me the 'Ace & Tate' pair (they found them fine) but 'Ace & Tate' can't find the 'Glasses Direct' pair.

  • Ultimately it is your mistake and you are responsible for putting it right. The companies can do there bit but it's not their problem.

    Of course you have, and you've already exercised that right so it was something of a retorical question. Unfortunately they haven't been able to meet your request, so the responsibility remains with you.

    You haven't and are unable to return glasses direct's property to them, therefore they are within their rights to bill you for loss of stock.
