You would be wise to remove the reference number from your most recent post.

It uniquely identifies you and everything posted in this thread can be related to you.

The parking companies trawl this forum just waiting for people to trip themselves up and can try and use your posts against you.

Quote Henry Greenslade's words from the POPLA Annual Report 2015 (Google it) back at them about a keeper not having any obligation to name a driver, nor can he/she be assumed to be the driver.

Prepare to defend the inevitable court claim that will follow, and take heart from all the other defence thread you now need to read. We see wins 99% of the time.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Thanks missed that last one.

Thank you. I have documented evidence I could not possibly have entered or remained on the land at the time they issued a ticket. So is there any defense in the fact their sign clearly states "BY ENTERING OR REMAINING ON THIS LAND YOU AGREE TO ABIDE BY ALL THE TERMS AND CONDITIONS"
    Thanks

Only if they are not able to rely on the POFA to hold you liable as keeper.

Excellent advice thanks, unfortunately ES parking are members of the IPC, so won't they just claim POPLA recommendations don't apply to them.
    Thanks

No, the point is that Mr Greenslade is the most eminently qualified commentator in the parking sector, being a parking expert barrister, and previously PATAS Lead Adjudicator and then POPLA Lead Adjudicator. A person with unique insight and knowledge of both Council and private parking law. And he understood the POFA Schedule 4!

But I wasn't telling you to expect ES to actually sit up and take notice! Such replies are purely to lay the groundwork for your research and future defence and evidence, so you know enough to win at a hearing and can show you didn't ignore the scam PCN.

Much appreciated thanks, and I understand your second paragraph, all about building a defence, I have watched My Cousin Vinny a few times!
    Thanks

  • Hi,

I am trying to contact Claxtome as I think he may be able to help with my case. I tried sending him a message but his mailbox is full, is there any other way to contact him.

    Thanks
