We werent informed by our lawyer that the ruling on our case would be given early on the morning of 11th July,the day after it was cancelled because of a public holiday. Mr Dusty's granddaughter works in a law office and happened to see it on the court list for the day,but of course by time her mother traveled the 50 miles to the court it was all over. Our lawyer had been there yet hadnt told the girls,weakly claiming that he was going to phone them with the result,which sounds dodgy to me.:(
The new chief magistrate read the ruling out. The former judge who has taken almost 5 months to write the ruling admitted that Mr Dusty is the owner of the land,and built the house years before he even met the defendant and the defendant was NOT his wife,as she is claiming,yet still he ruled that because she has nowhere to go (come on,elsewhere she has 4 adult children,and one daughter is married to a doctor!) she must be allowed to stay,and ''be given all that she asked for. '' whatever that means!
Her case was that she spent her own money doing repairs on the house,and that she had a relationship with Mr D so had moral rights to the property. Our girls actually heard the original magistrate mutter to his clerk ''this woman is a total liar'' when she was claiming a marriage etc! The fact that we have been in UK since 1982 didnt phase her at all. At one point we had to get a notary public to sign off that our marriage certificate,from 1970, was kosher,and that cost us £100,even though the court already had a copy.:mad:
The new judge was totally puzzled by the ruling and frankly said he couldnt see how the other bloke had come to the decision,but that was the ruling,and in the light of it he could not award us the damages of £9000 . Nothing has been said about just what ''rights'' she has,or can the girls go on the land and grow food(she had them arrested at one point saying they wanted to murder her!),or can she continue to have tenants etc.After all we own the house!Its crazy!Would we not be able to sellit,for instance,or would be become a sitting tenant .Or what about the huge utilities bills racked up and unpaid,and are still owed in our name? Apparently nothing said in the ruling.Its been a nightmare,and continues to be so.
Of course Mr D wants to appeal,which has to be done within 10 days of the ruling. Mr D is sure our lawyer is in cahoots with the defence lawyer,and doesnt believe he would have got in touch with us in time.Mr D talked with him on the phone and he said lodging an appeal would cost £500 and he would want paying £1000:eek:Yet an appeal judge only reads the documents,doesnt call witnesses etc.£1000 for a covering letter? He claimed that it would be very difficult to see a copy of the ruling.Why?Surely the plaintiff has a right to it? He then claimed that the clerk who would have to make us a copy would certainly procrastinate,unless we pay her to do it.Obviously we want to see the exact wording of the ruling so as to make decisions on what to do,but time is short.
Now that the case is officially over our lawyer admits that he was aware that the woman was splashing out with bribes left right and centre. But no bribes from us,so hard luck for justice.And the judge can tell us in the ruling that we have all legal rights on our side,but still awards to the defendant? Unbelievable.Arrant corruption all the way.:mad:
After all the legal case was based squarely on eviction,claiming she was an appointed agent who had fallen down on the job,by not paying bills,letting the place fall into decay etc etc,and the first judge(there have been at least four) ruled in our favour,and told the woman that she was lucky that we were offering her another house to live in,most men would have just dumped her stuff on the road! We have her signature agreeing to take that option,then she reneged on it,saying she was illiterate so hadnt understood the document.Then her lawyer started saying she was she had paid for building work out of her own pocket etc etc,so had rights to share ownership,and things went pear-shaped when she started claiming to be a common law wife of Mr D,and had had his child. What she didnt add was that she later sent that child to live with his real father,and admitted that he had just left school and had nothing,so she picked Mr D because he seemed well off! She was a good friend of a family member so Mr Ds mother had fallen for the story and let her move into the family home,where she did take care of my MIL in an exemplary way for 15 years till her death in 1996.Mr D let her stay on at the family home on condition that she act as agent to take care of the other house,the one under contention,in which she had never lived a day till she lied to get in and take possession of ostensiblyfor a party in 2012!.Still there!
None of that was on the original court docket,all the magistrate said at that time,Feb 2013 ,was that she should be allowed to stay in the house till it was sorted out exactly where she would move to. Her lawyer has spent 5 years delaying things,and now something not even on a legal court case docket is given in her favour? Poor Mr D is absolutely furious,incandescent with rage,and determined to appeal. He has spent £38 in 2 days on phone calls. He was texting our son in the US at four in the morning yesterday! He has raved incessantly for 3 days,hour after hour,I am really stressed.I only got 4 hours sleep last night,and he resumed his rant at 7 am today.What a life!
Oh dear,another War and Peace length post,I think this may be my longest ever. lol:D
Off now to make the dinner (salmon) and then the tribe will be here. Its DS1 s 42nd birthday tomorrow,so we are having early celebrations and will watch the England match.That last debacle was the last straw in a disastrous week!:rotfl:
Have now read 6 books,but am behind on my challenges what with all the kerfuffle this week.And with all the stress I have put on another pound in 3 days,putting me back to 3st 3lb loss.It was 4 stone in May.Total disaster.:(
Went to the podiatrist yesterday,didnt like her scraping my feet,:eek:but she said actually I am doing a good job taking care of them,the feet are healthy,and I dont need to go back again!YAY!Some good news for once.:T:T

I do hope you stay around and keep your diary going Dusty... Very selfish of me I know but I very much enjoy reading what you're up to!
Still thinking about it.I enjoy it,but as I am a ''hunt and peck'' typist and have severe arthritis I am very very slow.Its taken well over a minute just to type these 2 lines!:D So Iam here a lot of time. Since Mr Dusty has been around a lot for the footie and not doing his pools much since its out of season for the EFL he is down here instead of in his den,and he has commented repeatedly how much time I spend online.His temper is decidedly rough at the moment,and its leading to arguments,so I am having to cut down a lot on my online activity. He has gone to town so I am doing this now ,while the cat's away:rotfl::rotfl:
But I do spend many hours a day online on MSE,my LibraryThing,emails,googling stuff (even Mr Dusty has me checking up on facts etc several times a day),and of course reading books.It all adds up to an awful lot of time!:eek::eek:0 -
today's tasks;
+If its Monday its kitchen day,all the benches are a bit grotty from the the tribe on Saturday and Sunday dinner activity,so that needs doing,and the hob.. Have cleaned the microwave.I didnt put a lid properly on a plate last night and it got all messed up and I was too tired to clean it.I'll do quick blitz of the cupboard doors,and mop the floor after preparing (you guessed it) the roasties,cabbage and carrots. At least the beef is already done from yesterday.
+start the intermittent fasting . Intended to last week and everything went pear-shaped.Foodwise,I must get away from the carbs,I have fallen right back into stress eating,comfort eating,with a load of bread,even scones:eek:I am totally confused on nutrition/exercise advice online. Looking at advice on hyprthyroidism can give diametrically opposed advice.Walk,dont walk,HIIT,avoid HIIT,weight training is the best thing since sliced bread,dont do weight training.I did enjoy Dr Eric Berg'syoutube videos yesterday,I think I may fall in with his ideas.I can start the day on low carb,be doing SW by lunch,and the Eatwell plate by supper,with dire results!:rotfl::rotfl: More later hopefully.
+ get on with the reading. Halfway through the month and still havent tackled my Beautiful ''B'' challenge:(
+ Last day for my family history subscription. Want to add somemore records if possible. I have a long time ambition to do a Single Name study.More later on the family history,if Mr D is in a better mood:D
+and on top of that,I MUST establish regular exercise,without it my body is just not in any weight loss mode.Much cooler today(hell in the kitchen yesterday,it felt like 35C:)),so its more comfortable,but the feet are a bit dodgy. We'll see.

At last,a One Poll survey - but it was asking very personal questions about sexual health,asking your partner how many partners he has had , . Awful lot of ''unsures'' and ''dont knows'' or ''rather not says'' among my replies,but I got a whopping 10p for 2 minutes work,so who cares?:rotfl: Not so amused at a prolific survey offering £4 for a survey on taking medication,15 minutes in it just wouldnt let me go further :mad::mad:
My tin opener had suddenly sprung off in pieces in all directions,so I had to use a knife to finish off opening the tin,t short walk but the humidity was horrendous,I was walking very slowly and struggling for breath.My walk had to take in a few local shops to find an opener,got it at the 3rd shop and I noticed the price had gone up 10p since last time I bought one. Its one of those old -fashioned ones,but much more reliable than these purportedly better more modern ones which cost at least £2 and are worn out in months.My 89p one will last just as long:):)
Talk about prices going up.We just found out that the cost of international calls to Africa had gone up from £1 a minute to £1.75 on Mr Ds mobile. Disgraceful:mad::mad: Now that the regulators stopped phone providers from ripping off customers on holiday abroad in Europe with the huge roaming charges,it seems they are going to make their money from people mainly trying to keep in touch with family abroad.But a 75% price rise is way beyond the pale.In theory we should get free calls using whatsapp,thats what everyone tells us,and at first that seemed to be true,but now in the small print of the contract we see it says providers have the right to charge for or block whatsapp calls.You can see their point of view,look at all the money they are losing,but its a rotten situation.So £1 a minute last month,increasing to £1.75 this month - right when Mr D is ranting on the phone continually.He has had to go back to buying phone cards which works out at 70p a minute,but it is still so very expensive.

What a miserable post this was! Just a bad day really with three massive rows with Mr Dusty where simple comments about the court situation were roundly condemned as critical and disloyal. Two arguments on the phone with his daughters and the lawyer,who hasnt yet manage to get the document copied,after a whole ONE DAY,and its just a bad bad day,wish it was bedtime to get away from it all0 -

Mr Dusty was on the phone to Africa at 6.30 this morning. We paid a ''fee'' (ie bribe) for the court typist to make us a copy of the ruling,but she is ''very busy' with other work,'it will be a while.Then the original ruling is apparently full of typing errors. The new chief magistrate wants a new copy for the court and only then will she be free to make us a copy.And of course no attempt to even just scan it and email,nope,it has to be typed THEN we take it to a commercial firm (more outlay) to email it to us.
The court has now gone into summer recess till late August so no progress once again.
On a happier note I reached £22 on Prolific and when the cashout reaches me it will go to buy Amaz*n book vouchers,so I dont have to pull out cash for books the rest of this year hopefully:j
I have had a problem at the library over a book that I was supposed to have borrowed. It didnt ring a bell,and I ransacked the house,literally searched it from top to bottom,no book. I had to pay £16.99 as of course it had to be a new hardback,not a tatty old paperback. Thought I was going crazy (or crazier). Now 2 months later I took another book back to the library it turns out this book and the purportedly lost book have identical book numbers,which should never happen.I never had the other one,so they are going to pay me back,though the library assistant did warn me it could take months!:D Happy that its sorted,but so relieved that it wasnt my brain and memory at fault!I am getting so forgetful, this week alone I left several things behind at various places and was so upset when I couldnt find them at home. Its all the stress I am sure.So sick of ransacking the house looking for things. Good job I have done a lot of decluttering and relocating things,it is making it easier when I search to see if what I am looking for is there or not,but I am terrified its the start of dementia.
Dr Eric Berg has dire warnings about cortisol hormone flooding the body and slowing down weight loss,and advises to avoid stress. Chance would be a good thing!:rotfl: I probably am producing enough adrenaline and cortisol for 5 people,no wonder I cant lose weight.
From this week on I am doing a lower carb regime,eating mostly veggies,no bread and doing intermittent fasting.,but cant make my mind up about how much focus to put on protein,or on high fat.I think I have lost a pound this fortnight. Oh well,its a step in the right direction.0 -

Sorry about your rough day. Sometimes it happens and everything seems to go a bit wrong all on the one day. I do find I have early nights when it happens...

You are so right,Lonelyrat,its bewildering.The proponents of the various styles of diet are so partizan and zealous for their own thing that they cant admit that various methods will be successful. After all,despite the hype,you need to be in calorie deficit with your eating before your body will turn to using the stored body energy whether in the glycogen stores or fat. I do tend to side with lower levels of carbs but going down to 20 grams or so, when millions of healthy third world people eat 200-300 grams in a normal diet, is a bit extreme,sounds dodgy to me.I probably eat around 120 grams of carbs,but much of that is from veggies,packed with healthy vitamins etc so I dont feel guilty.The villains are the carbs in processed food,in combination with all those e-numbers,trans fats,corn oil etc. Our bodies dont like them and hastily stores them away in a cushion of water ,so we get bloated on top of everything else!
I like the thought of intermittent fasting,and cutting out all processed stuff and sugar,then eating masses of veg and protein
Of course I havent lost anything for months because of the thyroid. I see the doc about the results next Tuesday and we'll see whats what!0
