Parking Charge Advice - PCP Enforcement Agency QA Hospital

Good afternoon,

I'd be grateful for some advice regarding a parking change my wife received from PCP Enforcement Agency. She works for the NHS and she was parked within the grounds of the QA Hospital, Portsmouth. This is what has happened so far:

- Received PCN for not fully displaying a valid pay and display ticket.

- Wife wrote to PCP within 14 days stating that she had displayed a Staff Permit and that she believed she was parked within a staff car park.

- PCP replied stating that Staff Permits are not permitted for public parking spaces, referring to the Hospital parking policy and signs displayed in close proximity to where the vehicle was parked. They concluded that the charge notice was issued correctly and payment was required within 14 days.

- Wife wrote to PCP stating again that she believed the vehicle was parked in a correct bay with a Staff Permit visible. She asked for the evidence they had allegedly recorded.

- PCP replied providing images of the vehicle (circling a small A4 size sign 2 spaces away) and an image of her Staff Permit. An attached letter stated that her appeal was not upheld and that the charge had been returned to Collection as the appeals process has concluded. It also stated that further charges will be added if the charge remains unpaid.

My wife hasn't yet had the opportunity to check the car park signage circled in the image to confirm their claims. I would be grateful for advice on how she should now proceed.

    Has your wife complained to her employer?

    If the car was parked in a staff parking area the clearly the PPC are mistaken.

    Was the car parked in a staff area or not?

    She normally works at another location so she has not had the opportunity to check PCP's claims. She followed guidance provided by a colleague on where to park and was quite sure she was parked in the correct location. Not complained to her employer yet but she was considering that as the next step as well as visiting the site to check the signage.

    Unfortunately my wife already completed the actions listed above before I got involved, so it is too late to follow the guidance in the Newbies thread. I am requesting advice on how she proceeds now, considering that the suggested guidance has not been followed.

    Your options now are:

    1) pay.

    2) complain to the Portsmouth Hospitals NHS Trust and/or her employer.

    3) do nothing until (or unless) she receives a Letter Before Claim or court papers. Remember, the PPC have up to six years to start court action.

    Hardly likely to be litigious over a single ticket, especially given their previous track record, and these are any and all county court appearances; they may have nothing to do with unpaid parking charges.

    And remember it’s likely to cost them more to pursue at court than they are likely to recoup.

    Come back if your wife gets a LBC or MCOL paperwork.

  • Wow me too. I went to qa for a cat scan. Im nhs and had my staff ticket in car. I bought a ticket, displayed it, ran to appt (as took 30 mins to park!) came back within time to find ticket. On closing the door, wind had blown valid ticket under nhs disc. Appealed showing valid ticket and expkained. Appeal rejected. Whatcan i do? Pay it? Seems so unfair!!
