Flat advertised with residents' parking when none

  • Don't think there is any legal problem with "resident's parking" being 400 metres away on a public road, but happy (keen!) to be proved rong.

    If the "residents parking" is a public road, isn't that obvious from visiting the property? At the very least you would have seen that spaces weren't allocated and there wasn't any enforcement of who was parking.

    The selling agent may well have been misled by the owner. As long as they can show they've taken all reasonable steps to ensure details are correct, they've complied with their legal obligations. Even if they hadn't, there's nothing in the applicable legislation which provides for them to make recompense to you. There's provision for them to be fined, but any such fine goes to Her Majesty's offices.

    The OP does not say that the solicitor mentioned this issue before completion or after - you are all assuming.

    For all we know they could have asked AFTER completion, or eben after moving in.

    In which case they could have asked their solicitor about their remedies in the same call...and it would be interesting to know what (if anything) they were told by their solicitor about the title before it was too late.

    Having said that, if there isn't an allocated space there may be little practical difference between trying to find somewhere to park in a private or public car park. The OP says they only have trouble on "odd occasions" so it doesn't sound like a big deal either way.

    I think it's most likely that this was discussed prior to conclusion of missives, as this is when the solicitor would be doing the title check, but ... yes, the OP doesn't explicitly say so.

    If that's YOUR definition of resident's parking, most property in the country will have it.

    I recently purchased a flat which was advertised with residents' parking in additional to other off-road parking.

    Did you buy the property without taking a look yourself. To ascertain what the parking provision was like.

    Even if it was private parking for residents this is almost impossible to enforce in Scotland.
