Disputing default date

Back in January 2013 when I was self-employed I wrote to all my creditors and had to offer token payments as the business wasn't doing well. 3 of the 4 creditors recorded defaults in May 2013 but for some reason the last one didn't record a default until 2015.

I have a copy of the letter I sent, plus an email from them in October 2013 saying I was half way through a reduced payment plan and that if I wanted to end the reduced term early (and make normal payments), they would update credit reference agencies to say I was back paying the full amount, so it would help to gain credit in future - surely this is a sign that I was in default.

Can I dispute the default date and say that I defaulted earlier?

Yes. Ask for it be no more than 6 months from when you first defaulted.

Done some more digging and I knew the debt was sold to a collection agency however the history on file only starts from the date the collection agency bought the debt. Who do I write to to correct it - the agency or the original creditor?

Start with whoever owns it now.
  • Have settled a debt and the bank has closed my account, i'm looking at disputing the date it should be defaulted as its registered as 2 payments then 6 missed payments, 6 agreed payments, 2 defaults, 4 agreed payments then a missed payment and finally a default notice (30/10/2012) All the while a £600 overdraft has snowballed into £1900 (another thread perhaps). I should say this is a current account and was paying £1 month as agreed (or not)
should i cut my losses as should drop off October 2018 ?
