Refund instead of exchange

Hypothetically if I was to buy an item from a shop for say £16.00 and they had a refund/exchange 30 day policy and the item was now £50 and I wanted to exchange because the size was incorrect could they insist on refunding and then putting me in the position of buying at the higher price. Do they have a choice to choose? I was in the position recently but all sorted now but interested with the legalities.

They could legally refund you just the £16.0

Many shops will refund if it was purchased in a sale at a lot cheaper price. It is a well known scam that people buy things at 80% off etc knowing full well it is not the size they need so wait til shop gets it in their size and try to exchange it at full retail price. Thing is items are usually reduced to a lot cheaper prices because they are the sizes that are not sold.0
