Just a heads up. LTH do do court using Gladstones so get onto the Trust and hassle for a cancellation.

PS Some of the advice here is so out of date, it should come with a financial health warning.

  • Hi, hope you're all well. So we received another letter, this time on ZZPS headed paper (the last one was PCN Admin Centre) but both with the same postal address. Identical notice details and the following message:

Your unpaid PCN has been passed to us to resolve.

The balance owed is £75.00 and now includes late payment and debt recovery charges. What you should do next
    • Pay
    • Contact us
    • Telephone: 01932 918916
    • Email: customerservices@zzps.co.uk
    • Write: Address as at the head of this letter
    • Seek advice (details of how and where are contained overleaf) Please do not ignore this letter; we are here to help you resolve this PCN.

For your information, a recent Supreme Court ruling (ParkingEye -v-Beavis) has confirmed that a Parking Charge issued on private land is enforceable and the Parking Charge does not breach the Unfair Terms in Consumer Contracts Regulations 1999. We are instructed to continue to pursue the matter in the absence of any contact from you.

I hadn't checked back here until now so only just saw the message from IamEmanreau, should I still be contacting the trust and if so what sort of letter should it be, similar to the one sent to ZZPS in the first place, or just requesting a POPLA code? Thanks in advance.

Ask where your POPLA code is, on what basis they are pursuing a keeper when the case is non-POFA, and did they enjoy the Parliamentary debate last Friday, exposing the outrageous conduct of debt collectors and robo-claim solicitors cosily nestling with the rogue parking firms, and long overdue to be shaken up?!

    handy quotes here from Hansard:

    https://hansard.parliament.uk/commons/2018-02-02/debates/CC84AF5E-AC6E-4E14-81B1-066E6A892807/Parking(CodeOfPractice)Bill

The keeper cannot be held liable but if the PCN offered POPLA, you can ask, where is the POPLA code? And do throw in some quotes from Hansard, seeing as they tried to blind you with a largely irrelevant Supreme Court case that turned on completely different facts than your case.

Please also complain to your MP, pointing them to last Friday's parliamentary debate concerning the unregulated private [STRIKE]scamming[/STRIKE] parking industry.

PCN Admin Centre is just a trading name of ZZPS Ltd; so your PCN hasn't passed to ZZPS.

More importantly, debt recovery cannot be started whilst an appeal is in progress; therefore LTH are in breach of the Code of practice, (22.6 of the Code).

Parliament are introducing a bill to stop these customers scamming people in hospital car parks, watch this

and add to the fun by complaining in the strongest terms to your MP.
