Car phone Warehouse Refunds

Hi,

Please excuse me if I'm posting this in the wrong place but I was hoping for some advice regarding a refund issue.

At the weekend, I decided I wanted to make the shift from Apple to Samsung so went along to my local car phone warehouse to make the jump.

I purchased the phone using my credit card, the guy in the store didn't mention a single thing about any returns policy.

So, I took the phone home and later that evening put my SIM card into it. Pretty much immediately, I realised I had made a mistake and decided to reset the phone and go back to my iPhone.

The following day, I went on car phone warehouse live chat to ask if I would be entitled to a refund. The operative there said I would, I just needed to take the phone into the store.

So, armed with an email copy of the chat, I went into store to ask for a refund. The operative asked why and at first seemed fine, said he just needed authority from customer support. I also showed him the chat email.

Following his phone chat, the operative informed me that customer support were unwilling to authorise the refund but were willing to swap the phone.

I refused this as I had it in writing that I could have a full refund but the store assistant still refused.

My question is thus, am I entitled to a refund less than 24 hours after buying a product when the store didn't tell me anything about their returns policy and the chat operative said I would be fine to get the Refund, thus giving it me in writing.

Any help would be greatfully received.

When buying in store there is no automatic right to be able to return a item due to a change of mind. There is no requirement on the retailer to inform you of this as is it is the default. Of course a retailer may offer at their discretion a returns policy, and if they do they would need to advertise this.

I'm not sure a web chat would stand up as an offer, depends on how it was worded.
