Travel Insurer wont pay out

Would really appreciate some advice a friend booked a trip to spain for herself her husband and her parents in January 2017 she paid for a one trip policy with a travel insurer for the dates in October 2017 for the four of them all named on the policy, unfortunately the week before the trip her dad became unwell and was advised by doctors not to fly.
The insurer is now saying as the dad is just over his 80th birthday the insurance for him is void.
Surely at the time the insurance premium was accepted by them they had all the relevant birthdates it should have been refused ?
she was unaware there was an age limit on the policy, so they have refused his part of the flight hotel and transfer.
Can they do this ??

    Do you have a record of the quote with his date of birth? Is the latest illness a brand new one or is it connected to any conditions which you declared?

    Which Insurer is it?

    Which level of cover do you have with that Insurer?

    Have the Insurer sent you an official letter denying the claim and if so what is the exact wording on the relevant part declining the claim?
